Belinda Balluku is under investigation by the Special Prosecution Office, SPAK, for violations of equality in public procurement procedures. Such an accusation in Albania has a clear meaning. Suspicions of favoritism, conflict of interest, possible benefits from related companies.

Precisely for such cases, international law and accountability practice require that high-ranking officials remain away from duty until justice has done its job.

The reason is elementary: the active power of a minister has a real impact on the investigation. Therefore, suspension from office in such cases is not a punishment. It is a protection of the criminal process from politics.

Returning to office before the end of this process sends a double and dangerous signal. First, it shows that political status can keep an official in office, regardless of the seriousness of the charges. Second, it suggests that justice procedures can be interrupted or watered down when the highest figures in government are implicated.

The latter is the biggest consequence, as it is moral. In the era of Justice Reform, the belief is being recreated that justice is independent only for the weak. The strong or those with political protection always find the door to enter and the door to exit. This is the real problem.

Should a senior executive continue to exercise his functions while facing charges of corruption and tender manipulation?

Who has priority: The functioning of government? Or the preventive measures of criminal justice?

If the government has the upper hand, even when there are accusations with such strong evidence, then why did we create the Prosecutor's Office and the Special Court?

There will be a public plenary session on January 22, 2026. The decision of January 22 will also affect this one of December 12. But for now, the Constitutional Court has made a rather "broad" interpretation of immunity and executive powers.

The court's decision is not being discussed, okay. But as a message it is wrong. It turns out that judicial processes can slide back like before, as soon as politics moves the needle./GazetaDita
