"10 million Lek fine, or close the business"/ SPAK takes the inspector in Tirana to court!

SPAK closes the investigations and takes to trial the former official of the State Health Inspectorate Marvin Mersini, who is accused of fining a business.

The Special Prosecutor's Office Against Corruption and Organized Crime in cooperation with the General Directorate of the State Police as well as the Investigators of the National Bureau of Investigation, have completed the investigations and sent for trial to the Special Court of First Instance for Corruption and Organized Crime, criminal proceedings No. 126/2023, in charge of the defendant:

Marvin Mersini , accused of committing the criminal offense of "Passive corruption of persons exercising public functions", provided by article 259, second paragraph of the Criminal Code.

From the investigations carried out, it has been proven that, on 24.05.2023, the Special Prosecutor's Office was informed by the investigators of the National Bureau of Investigation, that the defendant Marvin Mersini, being an Inspector at the State Health Inspectorate, was not scheduled to check on various commercial entities, he went and exerted pressure on a commercial entity in the city of Tirana, claiming that he did not have the appropriate license for the continuation of the activity, and that the fine in these cases was up to 1,000. 000 (one million) ALL, as well as with the closure of the business until the liquidation of this administrative measure.

Further, the defendant told the administrator of the commercial entity that "such a problem" could be solved against the irregular benefit, only after receiving from him half the amount of the fine that is imposed in such cases, and more specifically the amount of 500,000 (five hundred thousand) ALL, but with the condition that a part of this monetary amount had to be paid within 24 hours, or otherwise the administrative procedures of applying the fine and closing the activity until the liquidation of the administrative measure would be continued.

Following the investigative actions carried out in the interest of this criminal proceeding, on 25.05.2023, the arrest in flagrante delicto of the defendant Marvin Mersini, with the duty of Inspector at the State Health Inspectorate, was finalized in the vehicle in which he was traveling. also seized the monetary sum of 200,000 (two hundred thousand) lek, obtained by him illegally.
