A scandal that borders on a criminal offense is accompanying the procedure for the sale of the Cerrik Plant land, a public asset that has been used as lawless territory for years, first by a failed concession and then by a completely contested auction procedure.

As Skyweb.al found from the documents reviewed, the Public Procurement Commission has recently intervened and found serious violations in the way the "Petrol Alba" Bid Evaluation Commission administered the auction, considering the process invalid and returning everything to zero.

In October 2024, “Petrol Alba” sh.a. (in liquidation) put up for sale the former refinery land with an initial value of 31.2 million lek. Four bidders participated in the competition: two companies, “Alb Building” and “DEHA 2010”, and two individuals, Gerti Shanaj and Antion Dollani.

After opening the bids, "Petrol Alba" disqualified the two individuals and declared the winner the company "Alb Building", which offered around 35 million lek, followed by DEHA with around 34.5 million.

But sparks of manipulation began to appear immediately.

Gerti Shanaj appealed the decision, considering the process manipulated, the criteria unfair, and the Bid Evaluation Committee involved in pre-determining the winner. According to him, the disqualification was unfounded and aimed at eliminating the real competition.

Faced with the accusations, "Petrol Alba" insisted that the procedure was legal and implemented in accordance with the rules.

Shanaj's complaint ended up in the Public Procurement Commission, which found serious procedural violations and illegal actions by the selling authority. In a decision formulated in strict legal language, the Public Procurement Commission considers the announcement of the winner an absolutely invalid administrative act, which does not bring any legal consequences and should be considered as never accepted by law, reports Skyweb.al.

In its decision dated June 10, 2025, the PPC annuls the letters announcing the winner, recorded by "Petrol Alba" on March 20, 2025, and requested the initiation of an administrative investigation by the Public Procurement Agency for the violations found.

The winner announced by Petrol Alba and disqualified by the KPP decision, "Alb Building", is a company closely linked to public tenders through contacts with figures close to the government.

In recent years, it has benefited from over 70 million euros in state funds, while it has also been punished for violating the law on money laundering and terrorist financing. The company is the builder of the overpass near TEG in Tirana, which was flooded after the first rainfall and brought serious consequences to urban traffic.

The former oil refinery in Cerrik, built with Soviet aid in the 1950s and operational until the late 1980s, was granted a concession to the Turkish company Kurum by the Berisha government in July 2013, just days before it left power. The contract envisaged the refinery's reactivation through an investment of 48 million euros. But no investment was made.

On the contrary, just a month after taking over, Kurum created the company "Albanian Oil Refinery", which in October 2013 began dismantling and selling the refinery for scrap.

According to a report by the Albanian Supreme Audit Office, the refinery's meltdown was carried out illegally, without the approval of the Ministry of Energy and in open conflict of interest, as the scrap was sold from the subsidiary to the parent company, both under the control of Kurum. Today, the Ministry is demanding 1.5 million euros in damages and the case is not yet closed.

The story of first the extortion and now the auction of the Cerrik refinery summarizes everything that can go wrong in a state: a failed concession, lack of accountability, unauthorized dismantling of state property, use of procedural platforms to exclude real bidders and an attempt to quietly transfer a strategic asset from the hands of the state to a public budget client. / skyweb.al
