Clash between ILD and the National Chamber of Advocates: Statements in the Assembly are denied by the institution of advocates

A strong institutional contradiction has emerged between the High Inspector of Justice (ILD) and the National Chamber of Advocates of Albania, following the ILD's reporting to the Parliamentary Committee on Civic Initiatives, Cooperation and Institutional Oversight.

In the report presented to the deputies, the ILD states that, in implementation of a recommendation of the Commission, it had addressed the National Chamber of Advocates with letter no. 3286, dated November 14, 2025, requesting proposals on the issues that should be included in the thematic inspections for 2026. The report further claims that by the time of its drafting, no response had been received from the Chamber of Advocates.

However, this statement has been publicly contradicted by the National Chamber of Advocates itself.

In the official statement dated July 10, 2026, the Chamber of Advocates calls the allegation of lack of cooperation untrue, emphasizing that it has continuously presented to the High Inspector of Justice concrete cases of violations of the law by judges and prosecutors, as well as requests for the initiation of disciplinary proceedings.

According to the Chamber of Advocates, instead of these complaints being handled with full investigations, the ILD's responses have been formal and bureaucratic, limited to standard letters with the content: "Your request was recorded", without any transparency on the verifications or concrete results of their follow-up.

The Chamber's statement also raises questions about the manner in which the ILD reports to the Parliament. According to it, the institution has informed the Parliamentary Committee about requests received from the Shkodra and Saranda Bar Chambers, while it has not provided transparency about the measures taken regarding the request of the National Chamber of Bars regarding the case of the detention of lawyer Ulian Barjami by the Elbasan Prosecutor's Office.

This contrast between the report presented to the Assembly and the official statement of the National Chamber of Advocates raises serious questions about the accuracy of the information reported to the deputies and about the real level of cooperation between the two institutions.

But the debate is not limited to just one letter.

For some time now, a significant number of lawyers have expressed concern that the High Inspector of Justice is not effectively exercising the powers granted to him by the Constitution and the law for the disciplinary investigation of magistrates. According to them, despite the large number of complaints filed over the years by citizens and lawyers regarding the conduct of judges and prosecutors, the concrete results in terms of disciplinary proceedings have not been at the expected level.

This has created the perception that the ILD is guaranteeing a status quo, rather than exercising active and effective control over the functioning of the justice system. The National Chamber of Advocates argues that this perception does not match the reality that citizens and lawyers experience every day in the courts, where delays, procedural violations and complaints about the conduct of magistrates continue to be the subject of discussion.

In this context, the clash between the ILD and the National Chamber of Advocates is not seen only as a dispute over an official correspondence, but as a broader debate on the effectiveness of accountability mechanisms in the justice system.

The High Inspector of Justice is now expected to provide a public clarification on the statements made before the Parliamentary Committee and on the claims raised by the National Chamber of Advocates, in order to avoid any doubts about the transparency and correctness of institutional reporting.
