SPAK sends the mayor of Devoll and three others for trial!

SPAK announcement:

The Special Prosecution Office against Corruption and Organized Crime has submitted to the Special Court on December 6, the request for the referral for trial of 5 defendants; Eduard Duro, Astrit Seferkolli, Gazmend Haxhija and Gazmend Mali for committing the criminal offense "Abuse of office", in collaboration, provided for by Article 248, 25 of the Criminal Code and Vojsava Bregu for committing the criminal offense "Abuse of office", provided for by Article 248 of the Criminal Code.

Violation in granting permission and authorization to the company "Genci Petrol" sh.pk

From the administered acts it results that legal violations have been found by the Bilisht Center Administrative Unit, with the issuance of a permit in 2015 and an authorization in 2020 to the company Genci Petrol”, sh.pk, for the fuel sales station in Devoll, Kapshtica. From 2015 and onwards, from the issuance of the permit and authorization in violation of the law, unfair benefits have been realized by this company.

While holding the position of Commanded Administrator of the Bilisht Center Unit, citizen Vojsava Bregu enabled the commercial company "Genci Petrol" sh.pk with license no. 4, on August 27, 2015 "for the retail trade of fuels + LPG", with the location of the commercial activity in Devoll, Kapshtica.

The granting of the permit was in violation of Law No. 8450, dated 24.02.1999 and Council of Ministers No. 170, dated 25.04.2002. The entity “Genci Petrol”, sh.pk at the time of its granting was not equipped with the required legal documentation; a. the control act, b. the use permit for the gas station and c. the authorization for entrances and exits on the road by the Albanian Road Authority, as a secondary interurban road.

From the administered acts it results that citizen Eduard Duro, in the capacity of Mayor of Devoll Municipality, in cooperation with officials of the Revenue and Licensing Sector in Devoll Municipality, Gazmend Haxhija and Gazmend Malo and the Secretary General of Devoll Municipality, Astrit Seferkolli, provided the trading company “Genci Petrol” sh.pk, with authorization no. 1543 prot., dated 23.06.2020 “For the retail trade of fuels, liquefied petroleum gas and lubricating oils, at the station on the national road Bilisht-Kapshticë, kilometer 10, near the Customs, Kapshticë”.

The above authorization was granted in violation of law no. 8450, dated 24.02.1999 and Council of Ministers no. 970 dated 2.12.2015 and at this time “Genci Petrol” sh.pk was not equipped with the required legal documentation; a. certificate of use of the gas station facility and b. authorization for entry and exit on the road from the road owner. For this illegal facility, by decision of the National Inspectorate of Territorial Protection no. 437, dated 04.10.2019, its demolition was also decided.
