Citizens who own end-of-life vehicles will be able to hand them over free of charge for destruction and recycling, while companies that manufacture or import vehicles for sale in Albania will bear all or a significant portion of the costs.
The government's draft decision defines two cases when owners may be required to pay, as well as new procedures for the final deregistration of cars.
The Ministry of Environment and the Ministry of Infrastructure and Energy have prepared a draft decision that changes the rules for the collection, destruction and recycling of end-of-life vehicles, defining the financial obligations of businesses and the rights of citizens who own these vehicles.
According to the document, citizens will be able to hand over their cars to authorized operators for destruction and recycling, without paying for the takeover, even when the vehicle no longer has market value.
Article 10 of the draft decision stipulates that "The authorized treatment operator and the entities provided for in point 4 of Article 8 of this decision shall take delivery of the vehicle at the end of its life at no cost to the last possessor or owner, even when the vehicle has no market value or has a negative market value."
However, two exceptions are foreseen. The operator may ask the owner to pay the treatment costs if the vehicle is missing essential parts, in particular the engine or the bodywork, or if waste that does not belong to it has been placed inside the car.
For individuals importing a vehicle for personal use, the draft decision does not establish a new fee to finance the recycling system. The obligations to cover the costs are referred to manufacturers, a term that in the document also includes professional vehicle importers.
Specifically, Article 4 defines that “Manufacturer” is the vehicle manufacturer or professional importer of the vehicle in the Republic of Albania.
This category includes companies and entities that import vehicles as part of their commercial activity, as opposed to a citizen who purchases and brings a vehicle from abroad for his or her personal needs. The draft decision does not provide a more detailed definition of a professional importer nor a threshold for the number of cars imported.
For entities included in the category of producers, Article 10 stipulates that "Producers shall bear, in whole or in a significant part, the costs of implementing point 1 of this Article, according to the rules set out in the legislation in force on extended producer responsibility".
The new rules will replace Decision No. 705, dated 10 October 2012, on the management of end-of-life vehicle waste. The draft decision was drafted in the framework of approximation with European Union legislation and is still in the draft phase. (Monitor)
