The Albanian Journalists Union and the Chamber of Advocates react sharply to the new regulation of the Special Court

The new regulations of the Special Court of First Instance for Corruption and Organized Crime regarding security, order and conduct on the premises of the institution, which are expected to enter into force in September, have provoked strong opposition. According to these regulations, drafted under the direction of acting president Erion Bani, there are several restrictions placed on the media and lawyers.

More specifically, the number of media participants is limited, the previous practice that allowed the media to film the first minutes of the court session is removed, filming in the corridors is prohibited, journalists must submit a written request 24 hours in advance to attend a court session, and finally, all existing annual accreditation authorizations and permits will be reviewed.

Furthermore, the possession and use of mobile phones, laptops and tablets inside courtrooms will be prohibited, and there will be restrictions for lawyers regarding the use of technological tools.

Journalists' associations have strongly condemned the new GJKKO regulation, with the Albanian Journalists' Union calling this regulation a restriction of media freedom, describing this "move" by Bani as an action taken because he "sees journalists as a threat to the judicial process."

The UGSH statement states: "UGSH finds that the Regulation and the commentary in this case have textual content instructing on how to violate the country's Constitution, Article 22 of which guarantees freedom of expression and the press. These two documents instruct and order how journalists are prevented from reporting and broadcasting, but mainly also how they are limited in recording the facts that occur in court."

Further, the concern of obtaining authorization 24 hours in advance has been raised, which the Union has considered a return of the media's right to be present on an "administrative permit".

The new regulation has also met with opposition from lawyers, with the head of the Albanian Bar Association, Professor Dr. Maksim Haxhia, in a reaction to Report TV, stating that he will propose to the structures of the Bar Association to boycott the sessions in this court.

"I will propose a boycott, because this situation cannot be allowed to continue like this. The only thing left is to abolish the legal profession altogether ," he said, among other things.

Gjykata e Posaçme për Korrupsionin dhe Krimin e |Organizuar (GJKKO) ka publikuar vendimin nr 49, datë 17.07.2026 “ RREGULLORE E BRENDSHME “PËR SIGURINË, RENDIN, SOLEMNITETIN DHE RREGULLAT E SJELLJES NË AMBIENTET E GJKKO-së"  dhe komentarin  PËR RREGULLOREN E BRENDSHME "PËR SIGURINË, RENDIN, SOLEMNITETIN DHE RREGULLAT E SJELLJES NË AMBIENTET E GJKKO-së". Janë dy dokumenta që përcaktojnë kritere, procedura dhe kufizime të reja për praninë e mediave dhe gazetarëve në këtë institucion.

 Komentari shoqërues  prej 532 faqesh në një kapitull të veçantë, mishëron disa kufizime që ngjallin shqetësime serioze, kur ballafaqohen me të drejtën për raportim dhe lirinë e medias. Kjo rregullore fikson procedura burokratike penguese për gazetarët, kufizime mbi numrin e gazetarëve dhe rregulla të reja për regjistrimet mediatike dhe praninë në mjediset e institucionit gjyqësor.

UGSH konstaton se Rregullorja dhe komentari në këtë rast, kanë përmbajtje tekstuale udhëzuese se si të shkelet Kushtetuta e vendit, neni 22 i së cilës garanton lirinë e shprehjes dhe të shtypit. Në këto dy dokumenta udhëzohet dhe urdhërohet se si gazetarët të pengohen të raportojnë dhe  të transmetojnë, por kryesisht edhe se si të jenë të kufizuar për të regjistruar faktet që ndodhin në gjykatë. Konventa Europiane e të Drejtave të Njeriut në nenin 6 të saj, garanton se proceset gjyqësore zhvillohen publikisht dhe neni 10 i kësaj Konvente  mbron të drejtën për informimin publik mbi funksionimin e drejtësisë.

UGSH vlerëson se këto dy dokumenta ekspozojnë bindjen e hartuesve dhe drejtuesve të këtij institucioni se media përbën një rrezik për procesin gjyqësor dhe për këtë arsye kanë krijuar një kapitull dhe pika specifike penguese e kufizuese për gazetarët, operatorët dhe mjetet profesionale të tyre në sallat e gjykimeve dhe mjediset e institucionit në fjalë.

Nga leximi i plotë i teksteve në fjalë, UGSH vëren se kërkesa për autorizim paraprak, kushtëzon praninë e mediave dhe e trajton aksesin nga një e drejtë në një leje administrative. Sipas kësaj procedure, po për seancat e papritura apo zhvillime të befta, kur media nuk mund të përmbushë afatin e përcaktuar në këtë rregullore, a nuk kemi precedentin e kufizimit pengues?!

The point where the limitation of journalists is determined, where the selection criteria are missing, violates the principle of the right of presence of each media and informational pluralism. The lack of these criteria in the Regulation and Commentary, gives the administration or security structures of the institution the attribute to select the presence of journalists and media, legitimizing the discretion of the administration to allow and refuse entry.

The European Convention on Human Rights in Article 10 stipulates that restrictions must be foreseeable and based on clear criteria. The next point of the regulation, which stipulates the restriction of photography and recording, carries the risk of absolute prohibitions. This comment, in our view, is a source of additional restrictions. At the same time, in our opinion, the concept of presuming the media as a threat to order, conflicts with the principle of publication of judgment.

In these two documents, there is no appeal mechanism; if a journalist or media outlet is rejected, there is no procedure to challenge the decision.

The next point where the accreditation criteria are defined presents serious problems for the editorial offices and the profile reporters themselves who follow the processes in this institution. The realization of this accreditation process by the Court once a year is absurd and disqualifies from this right not only many reporters, but may also hinder the media that have secured this accreditation, if the reporter, for one reason or another, leaves work and activity for a period of time. The fixed accreditation procedure does not provide for replacements and subsequent accreditations.

UGSH brings to the attention of the drafters of these two documents and the heads of this institution, that previous decisions and processes in high European institutions of justice have reference validity in order to avoid violations and infringements of the fundamental law and the European Convention on Human Rights.

The Albanian Journalists' Union, based on the principle that the media is the public guardian of democracy, notes that these two basic documents for the relationship of the GJKKO institution with the media and journalists, define concrete guidelines on how to administer the media, severely limit its access, especially due to limited accreditation, etc.

UGSH appeals to this institution to reconsider these two documents in the chapters on media relations. We request immediate editorial intervention.

Meanwhile, we appeal to the European Union Office in Tirana as the main donor and supporter of Justice Reform, the American Embassy in Tirana, the OSCE Representative Office in Tirana, and international institutions that monitor fundamental freedoms in our country, to exercise their immediate influence, to prevent such regulations and comments from becoming models of censorship and violation of fundamental freedoms within a special court such as the GJKKO.
