During the meeting of the Council of Ministers, the company "KAYO" was authorized to carry out the production and trade of weapons or their parts, ammunition, technologies, equipment, clothing and tools produced or adapted in Albania or services for use by security structures, subordinate bodies of security structures or state joint-stock companies created by these security structures.

The decision states that the goal is to ensure the supply of products or services to the entities specified in this decision.

"KAYO" must submit to the requesting authorities the list of products and services it offers itself or through companies created by it, at least every six months.

The decision also sets out the rules that must be applied when requesting supplies, etc.

Decision on Authorizing the state joint-stock company "KAYO", sh.a., to, by itself or through other entities created by it, carry out the production and trade of weapons or their parts, ammunition, technologies, equipment, clothing and tools, produced or adapted in the territory of the Republic of Albania, or services for use by security structures, subordinate bodies of security structures or state joint-stock companies created by these security structures

In accordance with Article 100 of the Constitution and point 5, Article 5, of Law No. 88/2024, “On the establishment of a state company for the production and trade of weapons, ammunition, military equipment and technologies”, upon the proposal of the Minister of Defense, the Council of Ministers

DECIDED:

1. The object of this decision is:

a) authorization of the state joint-stock company "KAYO", sh.a., to, by itself or through other entities created by it, carry out the production and trade of weapons or their parts, ammunition, technologies, equipment, clothing and tools, produced or adapted in the territory of the Republic of Albania, or services for use by security structures, subordinate bodies of security structures or state joint-stock companies created by these security structures;

b) determining the rules, to be applied by the entities specified in letter “a” of this point, for the supply of products manufactured or adapted in the Republic of Albania or services, in accordance with the provisions of Law No. 88/2024, “On the establishment of a state company for the production and trade of weapons, ammunition, military equipment and technologies”, through the state joint-stock company “KAYO”, sh.a., or other entities established by it.

2. Qëllimi i këtij vendimi është që t’u sigurojë subjekteve të përcaktuara në pikën 1, të këtij vendimi, furnizimin me produkte apo shërbime, në përputhje me dispozitat e ligjit nr.88/2024, “Për krijimin e shoqërisë shtetërore për prodhimin dhe tregtimin e armëve, municioneve, pajisjeve dhe teknologjive ushtarake”, nëpërmjet shoqërisë aksionare shtetërore “KAYO”, sh.a., apo subjekteve të krijuara prej saj.

3. Shoqëria aksionare shtetërore “KAYO”, sh.a., dërgon pranë autoriteteve kërkuese listën e produkteve dhe shërbimeve, që ofron vetë ose nëpërmjet shoqërive të krijuara prej saj, minimalisht çdo 6 (gjashtë) muaj.

4. Të gjitha autoritetet kërkuese, të përcaktuara në pikën 1, të këtij vendimi, që gjatë ushtrimit të veprimtarisë së tyre kanë të nevojshme furnizimin me produkte apo shërbime nga shoqërisë aksionare shtetërore “KAYO”, sh.a., detyrimisht i drejtohen me kërkesë kësaj shoqërie për të përfituar produktet apo shërbimet që ofron ajo, bazuar në listën e produkteve dhe shërbimeve që ofron vetë ose nëpërmjet subjekteve të krijuara prej saj.

5. Kërkesa, sipas pikës 4, të këtij vendimi, paraqitet në formë shkresore dhe shoqërohet me projektin për mallrat ose shërbimet e kërkuara. Në projekt përfshihen qëllimi i përdorimit, referencat ligjore, specifikimet teknike të mallrave ose shërbimeve, mënyra e zbatimit dhe vlera e projektit.

6. Shoqëria aksionare shtetërore “KAYO”, sh.a., shprehet për mundësinë e furnizimit, sipas kërkesës së administruar nga autoriteti kërkues, me produkte apo shërbime nga vetë kjo shoqëri ose shoqëri të krijuara prej saj.

7. Në rastet kur shoqëria aksionare shtetërore “KAYO”, sh.a., shprehet se nuk mund të furnizojë autoritetet kërkuese, në përputhje me specifikimet teknike apo projektin e parashturar, autoritetet kërkuese vijojnë me realizimin e prokurimit, sipas kuadrit ligjor në fuqi për prokurimin publik ose prokurimin në fushën e mbrojtjes dhe sigurisë.

8. Në rastet kur shoqëria aksionare shtetërore “KAYO”, sh.a., nuk shprehet brenda 30 (tridhjetë) ditëve nga marrja e kërkesës lidhur me mundësinë e realizimit të furnizimit, kërkesa konsiderohet e refuzuar dhe autoritetet kërkuese vijojnë me realizimin e prokurimit, sipas kuadrit ligjor në fuqi për prokurimin publik ose prokurimin në fushën e mbrojtjes dhe sigurisë.

9. Në rastet kur shoqëria aksionare shtetërore “KAYO”, sh.a., mund të furnizojë autoritetet kërkuese, në përputhje me kërkesën e paraqitur prej tyre, vetë ose nëpërmjet subjekteve të krijuara prej saj, autoritetet kërkuese hyjnë në negociata të drejtpërdrejta me këtë shoqëri për plotësimin e nevojave të tyre, në marrëveshje ndërmjet palëve.

10. Ngarkohen shoqëria aksionare shtetërore “KAYO”, sh.a., të gjitha strukturat, që operojnë në fushën e mbrojtjes dhe sigurisë, dhe organet e tyre të varësisë apo shoqëritë aksionare shtetërore të krijuara prej tyre për zbatimin e këtij vendimi.

Ky vendim hyn në fuqi menjëherë dhe botohet në “Fletoren zyrtare”.

The company was founded in 2024, inheriting the production capacities of the Medical Explosives Plant, the Gramsh Mechanical Plant, and the Poliçan Mechanical Plant.

It operates in the defense and security industry, providing products and services to the Albanian Armed Forces and international markets.

The goal is to create an efficient and competitive market for the military industry, integrated into regional and global markets.

The company's main objectives are several, including "the establishment, development and strengthening of the arms production and trading industry, with the aim of ensuring the needs of the Armed Forces and security in the Republic of Albania, as well as the realization of economic profit."
