Requested the exclusion of Irena Gjoka, GJKKO again rejects Fatmir Mediu's request

The next hearing on the Gërdec explosion case took place this Tuesday at the Special Court against Corruption and Organized Crime (SCOC), where the defendant is former Minister of Defense, Fatmir Mediu, accused of the criminal offense of "abuse of office".

The hearing took place before Judge Irena Gjoka and Special Prosecutor Arben Kraja. During the hearing, Medi's defense attorney, Henrik Ligori, presented several submissions in defense of his client, opposing the charges brought by the Prosecution.

According to Ligori, the Ministry of Defense is a structure with two levels of management: a political part and a technical part represented by the General Staff. He emphasized that technical responsibilities related to issues such as ammunition calibers or transportation processes cannot be attributed to the political minister.

"The Ministry of Defense is a structure with two heads, the political part and the General Staff. The people who were responsible for Gërdec have taken responsibility. There is no legal act that divides ammunition into large or small caliber. The Minister of Defense is responsible for the policies of the ministry and cannot be accused of not knowing the calibers. These are issues that belong to the General Staff," Ligori declared in court.

He also added that issues related to transport and invoices are not within the competence of the minister, as there are special structures within the ministry for these processes. According to the defense, the accusation raised by the prosecution is unfounded.

During the hearing, Judge Irena Gjoka also read the decision on the defense attorneys' request to exclude her from the trial of the case. Gjoka announced that the request has been rejected.

"After consideration, the defense's request was ruled inadmissible. Failure to meet the deadline also resulted in the lawyers' request being inadmissible," she stated.
