A company that was twice banned for serious tender abuses is strongly returning to the "game", in an attempt to win big procedures again. The lobbying of health oligarchs has led to the justice system removing one of the two punitive measures against the MSE company, which was caught "off guard" by cheating with documents in at least two procedures, one in Tirana and one in Shkodra.

A few days ago, Vox News published documents that this company, once owned by Arbër Teqja, has lifted one of the two suspensions, with a highly questionable decision by the Administrative Court. A clear message that very soon for everyone, as these decisions are putting into "play" not only the institutions that make tenders, but also those that enforce the law.

If you have cheated with documents, isn't it a criminal offense? Why aren't these violations investigated, but are they only put into the ordeal of the administrative process, with decisions and counter-decisions? A clear scenario that behind this company there are very powerful people, with connections up to the governing dome. It seems that these very lobbies are putting a company that has cheated and should have been investigated by these bodies back on the "market".

Vox News has previously reported that the company in question, which has passed through several hands and names, including those of important oligarchs, has been excluded precisely for fraud in medical equipment maintenance tenders. Naturally, the fraud, in addition to the economic damage, has also caused irreparable damage in maintenance, perhaps even at the cost of patients. But no one is verifying these problems sufficiently, aggravating the situation.

As time goes by, the same fraudulent firm, MSE, is again aiming for a lucrative tender in the same field. In recent days, Vox News has learned that the University Hospital Center will open a tender for the maintenance of medical equipment, with a very high value. In the register of forecasts, the procurement procedure "maintenance service for heavy medical equipment manufactured by Philips \ Siemens or equivalent" has been published. The limit fund is 230 million lek, or over 2.3 million euros, as it concerns medical equipment.

More than the expected open procedure, what is "smelling" about this tender is that it is suspected to be in favor of the MSE company. Our editorial team has learned that the lobbying or attempts to lift the two suspensions are being made precisely so that the firm can win this lucrative tender.

Në muajin shkurt 2026, Agjencia e Prokurimit Pubik, ka nxjerrë një njoftim të ri për vendimin e datës 13 shkurt 2025, që vendosi të përjashtojë me 12 muaj kompaninë MSE nga e drejta për të fituar kontrata publike.

“Kundër këtij vendimi, shoqëria ‘MSE’ shpk, i është drejtuar Gjykatës Administrative të Shkallës së Parë, Tiranë, ku ndër të tjera ka kërkuar shfuqizimin e aktit administrativ të 13 shkurtit të APP-së, si dhe dhënien e vendimit me ekzekutim të përkohshëm. Gjykata në dhjetor 2025 ka vendosur pranimin e kërkesës për sigurimin e padisë, si dhe pezullimin vendimit të APP-së, deri në përfundim të themelit të gjykimit me vendim të formës së prerë”, thuhet në dokument.

Më pas, citohet se APP ka vijuar duke proceduar me heqjen e emrit të këtij operatori ekonomik nga lista e operatorëve ekonomikë të përjashtuar nga e drejta për të fituar kontrata publike. Ky vendim qëndron në fuqi deri në marrjen e një vendimi përfundimtar.

“Ndërkohë, llogaria e përdoruesit në sistemin e prokurimit elektronik të operatorit ekonomik ‘MSE’ mbetet e bllokuar, pasi ky operator ekonomik ka një masë tjetër në fuqi të dhënë nga APP me vendimin Nr. 35/2025, e cila përfundon në datë 22.05.2026 (datë e përfshirë në përjashtimin)”, thuhet në dokumente.

Në fund të vitit 2025, aksionerët e kompanisë MSE kanë rritur kapitalin e shoqërisë. Aksioneri kryesor është shoqëria “Cambridge Pathology” B.V, e cila zotëron 80% të kapitalit të regjistruar të shoqërisë. Më pas, ish-punonjësi i Klodjan Allajbeut, Arbër Liçaj, zotëron 10 %. Pjesën tjetër, por 10 % i ka një shtetas turk, Can Kutay Orten. Kapitali i shoqërisë u rrit në vlerën e 30 milionë lekëve, nga 6 milionë që ka qenë më parë. Një rritje e konsiderueshme, ndoshta në tentativë për t’a rihedhur në treg dhe në një kohë “sulmi” ndaj kujtdo.

Kjo kompani, sipas të dhënave zyrtare nga Qendra Kombëtare e Biznesit, ka qenë në pronësi të z. Arbër Teqja, i cili është larguar edhe nga biznesi i mbetjeve spitalore, duke ia shitur kompaninë po Klodjan Allajbeut. Në vendimet e përjashtimit, MSE-ja dyshohej se kishte përdorur të dhëna të rremë dhe ka mashtruar për të fituar një super tender në Spitalin Rajonal të Shkodrës. Ajo ka arritur të marrë plot 230 mijë euro, bëhej fjalë për tenderin me objekt “mirëmbajtja full risk e pajisjeve mjekësore të prodhuesit Philips”.

Ndërkohë, më herët MSE u përjashtua edhe për tenderin e QSUT-së me objekt “mirëmbajtje e pajisjeve të mëdha mjekësore të prodhuesit Philips me fond limit 88.858.534 lekë, të datës 24 tetor 2023”.
