SPAK violated the law by dismissing the investigative case against two special prosecutors who turned a blind eye to the evidence for Arben Ahmetaj.

The report of the journalist Adriatik Doçi against the two prosecutors of SPAK, Ened Nakuçi and Klodian Braho, with the accusation of misuse of duty, concealment of evidence and diversion of investigations was dismissed by their colleague of SPAK, Alfred Shehu.

This constitutes a violation of the law by the highest justice body, SPAK, which indirectly saved the former Minister of Finance, Arben Ahmetaj.

If we refer to the Code of Criminal Procedure, a SPAK prosecutor cannot examine a complaint against two of his colleagues, as it is in conflict of interest.

Article 78 of the Code of Criminal Procedure states that Doçi's report should go to the prosecutor's office of ordinary jurisdiction, specifically to the Prosecutor's Office of Tirana.

Also, the act of abuse of office is not within the jurisdiction of the SPAK, since the Prosecutor of the SPAK is not a subject provided by Article 75/a of the Code of Criminal Procedure.

Simply put, SPAK has violated the law to protect the two prosecutors, dismissing the report for deviation of investigations, for undisputed evidence against the former Minister of Finance, Arben Ahmetaj.

Now it remains in the hands of the Special Court for Corruption and Organized Crime to examine the appeal of the journalist Adriatik Doçi.

For days, Top Channel has published dozens of hotel invoices paid by the boss of the incinerators, Klodian Zoto, to Arben Ahmetaj, during the granting of the concession for the Elbasan incinerator.

In a normal country, Ahmetaj should resign from politics and be charged by the justice bodies.

But until now, Ahmetaj has never been summoned to the Special Prosecutor's Office to give explanations. In fact, a few days ago, he defied the justice authorities by going on Christmas vacation to another expensive hotel in Switzerland, where a night's stay started from 2000 euros. /TCH
