Drug trafficking to the EU, GJKKO sentences members of the criminal group to 157 years in prison, two innocent

Interceptions of the criminal group and seized drugs

 

 

GJKKO has sentenced the members of a criminal group that transported drugs from Albania to the countries of the European Union to a total of 157 years in prison.

Part of this group are Endrit Bakiu, Sulo Pajo, Arian Tola, Fadjon Cami, Viron Lekaj, Artan Agalliu, Shpëtim Pjeshka, Jani Çavo, Kudret Rustemaj, Besnik Ruçi, Pirro Çapi, Jani Meçja, Edmond Kabashi, Mirash Gjoni, Sonila Sula and Artur Sulaj.

Most of them were sentenced to 12 to 14 years in prison, while only Kudret Rustemaj and Sonila Sula were declared innocent.

This structured criminal group cooperated in the trafficking of narcotics, mainly cannabis and heroin, through trucks from Albania to Montenegro, Italy and other EU countries, in several episodes documented by SPAK since 2021.

NOTICE:

1. The Special Prosecutor's Office against Corruption and Organized Crime submitted to the Court the request with the object: "Sending to court the criminal case against the defendants: Endrit Bakiu, Sulo Pajo, Arian Tola, Fadjon Cami, Viron Lekaj, Artan Agalliu, Shpëtim Pjeshka, Jani ?avo, Kudret Rustemaj, Besnik Ruçi, Pirro Çapi, Jani Meçja, Edmond Kabashi, Mirash Gjoni, Sonila Sula and Artur Sulaj.

2. The trial of this case took place with the rules of summary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judges Erjon Çela, Erjon Bani and Rudina Palloj, with decision No. 72, dated 05.12.2024 decided:

1. The guilty declaration of the defendant Endrit Bakiu, for the commission of the criminal offense "Structured criminal group", in the form of participation, provided for by article 333/a/2 of the Criminal Code and based on this provision his punishment with 2 (two) years of imprisonment.

• In the application of Article 406/1 of the Code of Criminal Procedure, 1/3 is deducted from the above measure of punishment, finally sentencing the defendant Endrit Bakiu to a single final sentence of 1 (one) year and 4 (four) months of imprisonment. .

• The sentence for the defendant Endrit Bakiu will begin on the day of execution of this decision and will be served in a high-security prison.

2. The guilty plea of ??the defendant Sulo Pajo, for the commission of the criminal offense "Trafficking in narcotics", remaining in the attempt, carried out in cooperation in the special form of the structured criminal group, (for episodes no. 1 and 3), provided for from article 283/a/1 – 22-28/4 of the Criminal Code and in relation to article 334/1 of the Criminal Code, his punishment with 13 (thirteen) years of imprisonment.

• The guilty declaration of the defendant Sulo Pajo, for committing the criminal offense "Structured criminal group", in the form of participation provided by article 333/a/2 of the Criminal Code and based on this provision his sentence of 3 (three ) years of imprisonment.

• Pursuant to Article 55 of the Penal Code on sentencing for the commission of several criminal offenses, the defendant Sulo Pajo was sentenced to a single sentence of 13 (thirteen) years of imprisonment.

• In application of Article 406/1 of the Code of Criminal Procedure to the above measure 

1/3 is deducted from the sentence, finally sentencing the defendant Sulo Pajo to a single final sentence of 8 (eight) years and 8 (eight) months of imprisonment.

• The serving of the sentence for the defendant Sulo Pajo will start from the day of the execution of this decision and will be carried out in an IEVP, high security prison.

• Suspension of the trial of the criminal case in charge of the defendant Sulo Pajo, accused of committing the criminal offense "Trafficking of narcotics" remaining in the attempt, carried out in collaboration with the special form of the structured criminal group, (for episode no. 4 ), provided for by article 283/a/1 – 22-28/4 of the Criminal Code, since in application of articles 387/1 and 328/1/e of the Criminal Code, it results that the defendant was previously tried for the same criminal offense by a final decision.

3. The guilty declaration of the defendant Arian Tola, for committing the criminal offense "Trafficking in narcotics", in cooperation in the special form of a structured criminal group, (for episode no. 8), provided by article 283/a/1 -28/4 of the Criminal Code and in relation to Article 334/1 of the Criminal Code, his sentence of 12 (twelve) years of imprisonment.

• The guilty declaration of the defendant Arian Tola, for the commission of the criminal offense "Structured criminal group", in the form of participation provided by article 333/a/2 of the Criminal Code and based on this provision his sentence of 2 (two ) years of imprisonment.

• Pursuant to Article 55 of the Penal Code on sentencing for the commission of several criminal offenses, the defendant Arian Tola was sentenced to a single sentence of 12 (twelve) years of imprisonment.

• In application of Article 406/1 of the Code of Criminal Procedure, 1/3 is deducted from the above measure of punishment, finally sentencing the defendant Arian Tola with a single final sentence of 8 (eight) years of imprisonment.

• The serving of the sentence for the defendant Arian Tola will start from the day of his arrest and will be carried out in an IEVP, high security prison.

4. The guilty declaration of the defendant Fadjon Cami, for the commission of the criminal offense "Trafficking of narcotics", remaining in the attempt, carried out in cooperation in the special form of the structured criminal group, (for episode no. 1), provided by the article 283/a/1 -22- 28/4 of the Criminal Code and in relation to article 334/1 of the Criminal Code, his punishment with 12 (twelve) years of imprisonment.

• The guilty declaration of the defendant Fadjon Cami, for the commission of the criminal offense "Structured criminal group", in the form of participation provided by article 333/a/2 of the Criminal Code and based on this provision his punishment with 2 (two ) years of imprisonment.

• Pursuant to Article 55 of the Penal Code on sentencing for the commission of several criminal offenses, the defendant Fadjon Cami was sentenced to a single sentence of 12 (twelve) years of imprisonment.

• In the application of Article 406/1 of the Code of Criminal Procedure, 1/3 is deducted from the above measure of punishment, ultimately sentencing the defendant Fadjon Cami to a single final sentence of 8 (eight) years of imprisonment.
