Wanted by SPAK for the AKSHI scandal/ Bank of Albania revokes license of Ermal Beqiri's electronic money company

The Bank of Albania has decided to revoke the license of the electronic money financial institution, Soft & Solution, owned by businessman Ermal Beqiri, who was declared wanted by SPAK as part of the investigations into the AKSHI scandal.

The decision came after the Special Prosecution Office issued an arrest warrant against the shareholder of the company in question, in December last year, on charges of participating in a structured criminal group.

The charges were not directly related to the activity as a financial institution, but nevertheless the Bank of Albania judged that this institution no longer met the criterion of a suitable shareholder reputation to carry out financial activities.

Soft & Solution was licensed by the Bank of Albania as an electronic money institution since November 2021. However, this institution had not had any activity of this type until last year, when it began providing payment services under the ALPay trademark.

ALPay was one of the entities connected to the e-Albania platform, for making payments for several services of public institutions.

In a similar precedent, in 2024, the Governor of the Bank of Albania, Gent Sejko, decided to revoke the licenses of the non-bank financial institutions Micro Credit Albania and Final, after receiving information that the personal security measure "house arrest" had been imposed on the shareholders of these entities by the First Instance Court of General Jurisdiction in Tirana.

Based on the regulation “On the licensing and exercise of activity by non-bank financial entities”, one of the criteria that non-bank financial entities must continuously meet during the exercise of their activity is that the founders of the entity have a good reputation. The regulation also stipulates that the Bank of Albania may suspend or revoke the license of a non-bank financial entity, if it no longer meets the conditions under which it was licensed.

The licensing of Soft & Solution was based on the same regulation, while the new, special regulation "On the licensing of payment institutions and electronic money institutions, as well as on the registration of payment service providers" entered into force at the beginning of 2022.

However, the new regulation, in Article 7, also stipulates that one of the criteria for refusing a license is when it is proven that at least one of the founders of the company is under criminal prosecution or has been convicted by a court with a final court decision for committing a criminal offense with high social risk.

The revocation of Soft & Solution's license has reduced the number of licensed electronic money institutions from 11 to 10.
