CFO Pharma Head Nadir Çausholli

The Tirana Prosecutor's Office has issued eight security measures as part of a broad investigation into document forgery and income concealment in the pharmaceutical sector, which also includes officials of the Mandatory Health Insurance Fund (FSDKSH).

At the center of the investigation is the company "CFO Pharma", suspected of creating a fictitious commercial scheme with the reimbursable drugs "Foster" and "Trimbow", in collaboration with the entities "Pharma Plus" and "Medix Albania" and with the involvement of public employees of the Fund. The director of FSDKSH, Spartak Zekja, has been arrested, while the administrator of "CFO Pharma", Frigull Milla, has been declared wanted.

Prosecutor's Office Announcement

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Tirana issues eight security measures for the criminal offenses of "Forgery of documents" committed in collaboration and "Hiding income" provided for by articles 186/2 and 180/3 of the Criminal Code.

In the framework of the investigations on criminal proceedings no. 4472, of 2025, conducted in cooperation with the Tax Investigation Directorate at the General Tax Directorate and the Economic and Financial Crime Section at the Tirana Police Directorate, it resulted that the person under investigation, citizen FM, administrator of the entity “CFO Pharma”, with his actions, has used the two entities “Pharma Plus” and “Nedix Albania” and their administrators for profit purposes, by presenting false data, he has purchased from these entities medications which “Nedix Albania” and “Pharma Plus” have created in their inventory statuses in the “edepo” system by falsifying the respective inventory as well as the purchase invoices. These actions have allowed both of these entities to have the ability to sell the medications “Foster” and “Trimbow” to the entity “CFO Pharma.

The investigations were initiated after the complaint of citizen I.Sh. administrator of the entity "Medicamenta" which is an exclusive pharmaceutical importer licensed and contracted with the Mandatory Health Insurance Fund, for the reimbursement of several medicines. He reported that he is aware of the fact that the entity "CFO Pharma" and the entities "Pharma Plus" and "Medix Albania" in collaboration with public servants of the Health Insurance Fund carry out illegal activities consisting of fictitious actions of sale and purchase of "Foster" and "Trimbow" products and as a result of these fictitious actions/inventories benefit from FSDKSH reimbursement funds in considerable monetary amounts.

From the data published by the Fund on the consumption of medicines, the data of the import and sales informant, but especially from the data in the statistics directorate at the Fund, an organized scheme was found with the aim of corruptly obtaining reimbursement funds in very large amounts. At the center of this organized scheme stands the pharmaceutical distributor "CFO Pharma" in collaboration with FSDKSH officials.

The distributors "Pharma Plus" and "Medix Albania" are distributors established "de facto" by the owner of "CFO Pharma", who have signed a contract with FSDKSH where they have declared fictitious figures for the initial inventory status, with the aim of subsequent fictitious sales to "CFO Pharma" and then to the pharmacy.

The entity “Pharma Plus” has declared 2000 boxes of “Foster” and 1107 boxes of “Trimbow” worth 10 million new lekë, without any purchase. The entity “Medix Albania” has declared 4000 boxes of “Foster” and 11 500 boxes of “Trimbow”, worth 60 million lekë, without any purchase.

The fact of the approval of these fictitious inventories and the conclusion of contracts with these entities by FSDKSH officials clearly indicates the involvement of Fund officials as part of this scheme. The fictitious sales of “Pharma Plus” and “Medix Albania” were made to “CFO Pharma” which issued fictitious invoices to several pharmacies.

Also based on the investigative actions carried out so far in the context of this criminal proceeding, there are suspicions that citizen SZ, Director of FSDKSH, has consumed the elements of the criminal offense “Forgery of documents” provided for by article 186/3 of the Criminal Code. Specifically, the person under investigation in the capacity of the General Director of the Fund has signed a Contract “On the Circulation of Medicines on the List of Medicines Reimbursed by the Pharmaceutical Distributor”, between the Mandatory Health Insurance Fund and the Pharmaceutical Distributor “Pharma Plus”. Likewise, the employees of FSDKSH, citizens RA, ZM and E. Gj., have consumed the elements of the criminal offense “Forgery of documents” provided for by article 186/3 of the Criminal Code. These citizens should have physically checked the medications that the administrator of the entity "Nedix Albania" had described in the inventory list, investigated by LB. From the control carried out and the verification of the medications in the warehouse of "Nedix Albania", these citizens have evidenced, according to them, that the entity's warehouse contained a quantity of 4,000 boxes of "Foster" type medication.

Based on the facts and evidence attached to this request, it is based on the existence of reasonable suspicion that these citizens are suspected of being the perpetrators of the crimes of "Forgery of documents" committed in collaboration and "Hiding income" provided for by articles 186/2 and 180/3 of the Criminal Code, and it is requested
