After SPAK checks, Israeli businessman Ron Yeffet is also facing trouble in the United States.

The fierce legal battle between Yeffet and his plaintiff, Mark Faist, in the Florida Court has taken a sharp turn, with the forced opening of Yeffet's bank accounts at stake.

Plaintiff Mark Faist, who accuses the Albanian government partner and close friend of Edi Rama of defrauding the Albanian government of $8.6 million, has filed a Motion to Compel, requesting that the court order Yeffet to submit a complete history of bank transactions for specific accounts at Regions Bank, Provident Bank and Spencer Savings Bank.

Faist claims that his money invested in construction projects in New York was never used for the contracted purpose, but Yeffet spent it for other purposes by deceiving.

The legal boomerang and the 30 million claim for Albania

Until now, this lawsuit could have remained a simple commercial dispute over non-repayment of debt after a repayment agreement. However, it was Ron Yeffet himself who expanded the matter by filing a defamation counterclaim against Faist.

Yeffet expressly claims in court documents that the fraud accusations that Faist spread against him to other businessmen have destroyed his reputation and cost him the loss of a major construction project in Albania, worth over $30 million.

This move by Yeffet has turned into a legal boomerang. Faist's lawyers explicitly argue that since Yeffet is seeking $30 million for Albania, claiming that the charges against him are false, he can no longer hide the bank statements in America.

Under Florida law, truthfulness is an absolute defense to defamation; if the bank accounts prove that millions of dollars were misused, the defamation charge is dropped and Yeffet's $30 million claim to Albania automatically burns.

Yeffet admits to fraud to avoid opening accounts

Faced with this risk, Yeffet's lawyers have filed an opposing motion, using a defensive tactic: that of stipulation, otherwise known as a factual agreement.

Yeffet's lawyers offer to formally admit before the judge that the investment funds were not used for development expenses of the said properties in New York.

Through this admission, they want to convince the court that Faist's request to control the banks is "excessive, abusive and disproportionate", since the main fact was admitted by their side itself.

However, Faist has officially rejected this offer, as the mere fact that the money was not used there does not indicate where it actually ended up (whether it was stolen or misused), which constitutes the core of his defense against the counterclaim. ( Kapitali.al )
