"Ura Vajgurore" massacre in '97, GJKKO sentences Fran Marashi to 108 years in prison and 4 life sentences

Fran Marashi, author of the serious massacre of "Ura Vajgurore" in 1997, has received one of the most severe sentences ever given by Albanian justice.

The Special Court found Marashi guilty of all charges, giving him a total sentence of 108 years in prison and 4 life sentences.

The serious massacre of June 17, 1997, with five police officers killed and six injured, was retried by the GJKKO after the Supreme Court's decision to return the case to the first instance.

Decision of the Criminal Court:

1. On 19.09.2023, the criminal case against the defendant Fran Marashi was submitted for trial to the Special Court of First Instance for Corruption and Organized Crime.

2. The trial of this case was conducted under the rules of ordinary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Erjon Bani, Flora Hajredinaj and Flojera Davidhi, with decision No. 21, dated 10.03.2025, decided:

1. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Creating an armed gang and criminal organization", in the form of participation in an armed gang, provided for by Article 333 of the Criminal Code (Law No. 7895 dated 27.01.1995) and, based on this article, his sentence to 10 (ten) years of imprisonment .

2. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Intentional Murder", to the detriment of the victim IB, committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by Article 76 of the Criminal Code (Law No. 7895 dated 27.01.1995), in connection with Articles 28 paragraphs 1, 3 and 4 and 334 paragraph 1 of the Criminal Code (Law No. 7895 dated 27.01.1995) and his sentence to 20 (twenty) years of imprisonment .

3. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Murder of State Police employees", to the detriment of the victim MK, committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by Article 79/bi of the Criminal Code, in connection with Articles 28 paragraphs 1, 3 and 4 and 334 paragraph 2 of the Criminal Code (Law No. 7895 dated 27.01.1995) and his sentence to life imprisonment .

4. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Murder of State Police employees", to the detriment of the victim A.Sh, committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by article 79/bi of the Criminal Code, in relation to articles 28 paragraphs 1, 3 and 4 and 334 paragraph 2 of the Criminal Code (law no. 7895 dated 27.01.1995) and his sentence to life imprisonment .

5. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Murder of State Police employees", to the detriment of the victim AS, committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by Article 79/bi of the Criminal Code, in connection with Articles 28 paragraphs 1, 3 and 4 and 334 paragraph 2 of the Criminal Code (Law No. 7895 dated 27.01.1995) and his sentence to life imprisonment .

6. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Murder of State Police employees", to the detriment of the victim IB, committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by Article 79/bi of the Criminal Code, in connection with Article 28 paragraphs 1, 3 and 4 of the Criminal Code and with Article 334 paragraph 2 of the Criminal Code (Law No. 7895 dated 27.01.1995), and his sentence to life imprisonment .

7. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Murder of State Police employees", attempted to the detriment of the victim Th.T., committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by articles 79/b and 22 of the Criminal Code, in connection with article 28 paragraphs 1, 3 and 4 and article 334 paragraph 2 of the Criminal Code (law no. 7895 dated 27.01.1995) and his sentence to 35 (thirty-five) years of imprisonment .

8. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Murder of State Police employees", attempted to the detriment of the victim Y.Dh, provided for by articles 79/b and 22 of the Criminal Code, in connection with article 28 paragraphs 1, 3 and 4 and article 334 paragraph 2 of the Criminal Code (law no. 7895 dated 27.01.1995) and his sentence to 35 (thirty-five) years of imprisonment .

9. The guilty plea of ??the defendant Fran Marashi for committing the criminal offense of "Unlawful Deprivation of Liberty", to the detriment of the victim KB, committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by Article 110 paragraph 2 of the Criminal Code (Law No. 7895 dated 27.01.1995), in connection with Article 28 paragraphs 1, 3 and 4 of the Criminal Code and with Article 334 point "I" of the Criminal Code (Law No. 7895 dated 27.01.1995), and his sentence to 8 (eight) years of imprisonment .

10. Based on Article 55 of the Criminal Code in the concurrence of sentences, the defendant Fran Marashi is finally sentenced to a single sentence of life imprisonment. 11. The sentence shall be served by the defendant Fran Marashi in a high-security prison, in compliance with Article 16, point 1, letter “a” of Law No. 81/2020 “ON THE RIGHTS AND TREATMENT OF PRISONERS AND PRE-DETENTIONERS”.

12. The procedural costs incurred during the trial according to the attached form shall be charged to the defendant Fran Marashi.

13. An appeal may be filed against this decision at the Special Court of Appeal for Corruption and Organized Crime, within 15 (fifteen) days, starting from the day after the notification of this decision.
