Italian Baroness Leaves 5 Million Euro Inheritance to Albanian Caretaker, 8
Baroness Anna Malfatti

Baroness Anna Malfatti, born in 1936, passed away in 2023, at the age of 87. She decided to leave her entire fortune to the Albanian cleaner: in addition to about one million euros in cash, the inheritance also includes six apartments, for a total value of nearly five million euros.

However, the baroness's eight grandchildren — represented by lawyer Claudio Malfer — have questioned the will and have launched legal proceedings. They have opened a civil case seeking the annulment of the will and, in parallel, have also filed a criminal complaint against the 44-year-old guardian — defended by lawyer Nicola Canestrini — accusing her of deceiving and manipulating the baroness.

charges

According to the Rovereto Prosecutor's Office, the 44-year-old woman took advantage of the baroness's grave mental state, at a stage that, according to them, prevented her from understanding and making conscious decisions. The indictment states that in March 2022, she convinced the baroness to draw up a will declaring herself the sole heir and guardian, and a month later, she also obtained a general notarial power of attorney, which gave her control over the property.

Pending the court's decision, the prosecution has requested and received court approval for the preventive seizure of all assets. The guardian, meanwhile, has not yet accepted the inheritance, as she says she does not want to receive it without clarifying whether she has the legal right.

Court proceedings

Two processes are underway: a civil one and a criminal one. The preliminary hearing was held on April 10, but the final decision will have to wait until May 8, when the investigating judge, Consuelo Pasquali, will decide whether to accept the civil party — the grandchildren — which has been opposed by the defendant's defense. After that, the judge will rule on the prosecution's request to take the case to trial, on the charge of fraud against an incapacitated person (circonvenzione d'incapace).

Guardian's protection

The guardian's lawyer, Nicola Canestrini, has raised another concern:

“I see the danger of racism in this process, even unconsciously,” he says. “The opposing side’s arguments mention ‘family tradition’ and ‘blood that must be respected,’ as if my client had not been important in the Baroness’s life.”

According to him, it's quite the opposite. He says that the caretaker continued to frequent the Baroness's house even after she no longer worked there, simply because the Baroness demanded that she be the one to help her go to bed.

Canestrini adds something else:

"In my 25-year career, I have never had the witnesses themselves call me: friends of the baroness and shop owners that she frequented with my client. Everyone has told me that the caretaker was more of a victim than a beneficiary of the situation."

The will video

The defense has another piece of strong evidence: a video showing the moment the will was drawn up, in front of a notary on March 21, 2022.

“In this video,” says Canestrini, “the baroness corrects the notary herself, telling him the exact name of the guardian. This clearly shows that she was fully aware of what she was doing.”

Medical expertise

Meanwhile, the prosecution has presented a psychiatric expertise, compiled on the basis of documentation collected after the Baroness's death, according to which her mental state had begun to deteriorate several months before her death, which occurred in November 2023.

All the evidence has already been presented. Now it's up to Judge Pasquali to decide: will the case go to trial, or will it be decided that there is no need to prosecute the Albanian caregiver./ Corriere della Sera
