Consequences of the justice reform/ Over 141 thousand stock files

Inside Story, in a request to the Supreme Court, has learned the exact number of files that are currently held hostage by the courts for various reasons.

As can be clearly seen from the table, the institutions with the biggest problems are those of the Appeals. The Court of Appeal of General Jurisdiction has about 45 thousand and 300 untried files, while the Tirana Appeal has about 24 thousand and 400 files. So, in the courts of appeal alone there are nearly 70 thousand cases. A terribly high number that clearly shows how many problems Albanian citizens have in getting justice in a timely manner.

"It is a well-known problem, the stock of files in the courts of appeal, whether general or administrative. The number of stock files is claimed to be a considerable number, 40-50 thousand files, unmanageable by the body that operates in appeal" , said Elis Dine, President of the Court of Elbasan. 

"It means that Albanian citizens do not receive justice services, civil, family, property, and criminal issues are not resolved, this is essential. The district courts, which were created when the Albanian state was founded, were closed. The appeal courts were closed, except in Tirana, citizens have to wait for years and weeks for a judicial process and it does not take place," said Besnik Muci, former prosecutor.   

"In criminal cases, if we make a comparison in general jurisdiction, they get stuck on appeal, as the judges there receive files from all over Albania from Shkodra-Tropoja and Saranda. This then causes a collapse," said Redi Rama j, a lawyer.

'The merger of the Courts of Appeal, since there were efficient courts of appeal such as the courts of Shkodra, Korça, Vlora, and the merger of all these courts in Tirana,' said Redi Ramaj, lawyer.

By making a simple calculation of the data provided by the Supreme Court of Kosovo, we understand that currently, apart from the special institutions, namely the Special Appeals Court and the Special Appeals Court, which have optimistic figures for the files we are reviewing, other institutions have significant problems.

It cannot be overlooked that the Supreme Court currently has around 17,700 files awaiting decisions. The situation in the Court of First Instance of Tirana is also worrying, with around 19,000 files awaiting decisions.

'According to information from the Supreme Court of Albania, there are currently 141,228 files in Albania waiting to be reviewed by Albanian courts at all levels'

If for specialists in the field, the new judicial map and the merger of the courts of appeal into a single one in Tirana have brought negative consequences by increasing the stock of files, the Supreme Court actually argues differently.

The new judicial map was approved after an in-depth and detailed study of the courts in the country and is built on the principle of increasing efficiency, unifying judicial practice, and more rational and optimal use of human resources, especially after the transitional reassessment process.

The number of cases transferred to the judicial system on January 1, 2025 is 137 thousand, or 2,467 cases less compared to the previous year./ Inside Story
