Xhaçka's mandate in the Constitutional Court, Bardhi: The Assembly

The Constitutional Court is holding a session today to examine the lawsuit of the DP regarding the mandate of Olta Xhaçka.

The head of the PD parliamentary group, Gazment Bardhi, explained to the jury the reasons why it was decided to pursue this case, while adding that the Assembly, by not implementing the first decision, challenged the Constitutional Court.

"About two years ago, our group submitted a request to the Assembly to review the incompatibility of Xhaçka's mandate.

After the delay, for the first time a decision taken by the CJK has been challenged by the Assembly by declaring itself sovereign over the decisions of the CJC.

Xhaçka's mandate is almost ending by itself. We were in two minds whether we should come to the GJK or leave the shame of this case to the majority. We decided that we should come because the challenge to the authority of the dignity of the CJK is a matter for every legislator who has sworn on the Constitution.

In this sense, any presentation of ours to explain to you a decision that you have made yourself, would be a waste of time. It is in the hands of the troop in will have to protect the authority of this building. We have done our duty. We brought it to the CJC by giving the members the opportunity to protect the dignity of the CJC", he said.

We recall that the Assembly of Albania decided on April 11 to reject the request of the Constitutional Court to bring the interpretation of its mandate to this court. The majority kept the decision for the deputy in the drawer for more than a year. Xhaçka held the position of Foreign Minister at the time when the Committee of Strategic Decisions headed by Prime Minister Edi Rama approved the status of "strategic investor" for her husband, Artan Gaçi, who is building a hotel in Dhërmi. Then, through a government decision, the hotel was granted the right of long-term use of the seashore.

Xhaçka insists that he is not in a conflict of interest and that he had not benefited from a centimeter of state land or any other type of public benefit. According to her, the only benefit from this status was related to the company that in the future will manage the activity for the beach area in front of the hotel. In January 2023, the Constitutional Court, responding to a lawsuit by DP deputies, rejected as unconstitutional the decision of the Assembly not to send the case to this court and asked the Assembly to decide otherwise.

The Constitution provides that no member of parliament can benefit from public goods and that he loses his mandate the moment the Constitutional Court comes to this conclusion. After the Parliament's decision, the opposition again brought Xhaçka's mandate to the Constitutional Court.
