Macron, Scholz and Meloni write to Kurt: You are jeopardizing membership in the
Prime Minister of Kosovo, Albin Kurti

The three most important states of the European Union have today asked the Prime Minister of Kosovo, Albin Kurti, to consider the draft proposed by the EU as a serious project and to consult it with the Constitutional Court of Kosovo.

They are against the proposal for a new draft and see it as a way to avoid the obligations that Kosovo has to be a functional state and fulfill its expectations for membership in the Council of Europe.

Full letter:

Berlin, Paris and Rome, 15 May 2024

His Excellency Albin Kurti

The Prime Minister of the Republic of Kosovo, Pristina

Dear Prime Minister,

Thank you for your letter regarding Kosovo's application to the Council of Europe and the Association/Council of Serbian Majority Municipalities (A/CSMM). Unfortunately, the steps you propose do not address the urgent need for decisive steps towards the establishment of the A/CSMM and risk further undermining the EU-facilitated Dialogue. First, the draft statute presented by the EU Special Representative for Dialogue, Miroslav Lajcak, is not just a "gentleman's proposal". It is a model…

Secondly, submitting this draft to the experts of the Council of Europe would not constitute a necessary decisive step as their opinion will not be legally binding. This can only be achieved by sending it to the Constitutional Court of Kosovo, so that it is admissible to the Court. As clarified with Brussels, there are no legal obstacles in the EU-facilitated Dialogue to take this step. Thirdly, your proposal for the preparation of a new draft in consultation with the current mayors or deputies of the municipalities is neither appropriate nor applicable to the current circumstances in these municipalities.

Mr. Prime Minister, let's be clear: There is a real risk that without a decisive progress of A/CSMM, Kosovo's application, the Council of Europe will not receive sufficient support from member states. Moving forward now along the lines suggested by Quinti would demonstrate your commitment to minority rights, thereby strengthening Kosovo's position and re-energizing the EU-facilitated Dialogue. This is the only way to ensure the success of your application.

Your actions and decisions at this critical moment will be decisive for Kosovo's aspirations for membership in the Council of Europe. The ball is in your court. We sincerely believe in your leadership.
