The Appeal Decision of the GJKKO for "structured criminal group" is challenged by SPAK and Zarka in the High Court

The Special Prosecution Office, SPAK, and its accused of corruption and illegal influence in the "Toyota Yaris" case, the former head of the Vlora Prosecution Office, Aurel Zarka, have appealed to the High Court against the decision of the Special Court of Appeal, which overturned the decision of the First Instance and returned the case for trial, after assessing that the evidence shows that the defendants in this case had acted within the framework of a structured criminal group.

The prosecutors in the case, Altin Dumani and Klodian Braho, agreed with the decision of the First Instance Court, which, in the application of the summary trial, sentenced former prosecutor Aurel Zarka to 2 years and 8 months in prison. They did not appeal to the Court of Appeal, but it was Zarka himself who insisted on his innocence and appealed the decision of the Special Court of First Instance.

The Special Appeal went further, finding the characterization by SPAKU and the three judges of the Special Court of First Instance incorrect, regarding the manner of Zarka's cooperation with the three co-defendants, and other persons who were not taken under investigation. SPAK and the First Instance assessed that the cooperation was simple with aggravating circumstances.

But, according to the Special Court of Appeals, the evidence and circumstances clearly show that not only the four defendants Aurel Zarka, Erjona Daupaj, Radovan Çela and Astrit Vladi, had acted as a structured criminal group.

The Panel assesses that in the five cases of the commission of criminal offenses by the defendant Zarka, no less than 3 and 4 people collaborated, respectively, fulfilling the provisions of point 4 of Article 28 of the Criminal Code, regarding the structured criminal group.

This decision of the Appeals Court was not considered fair, both by SPAK and by Zarka, who have presented their claims to the High Court.

According to SPAK, prosecutor Zarka and other individuals are accused of having exerted unlawful influence in eight criminal cases that were being investigated in four different prosecutors' offices - cases mainly related to organized crime activities such as money laundering or narcotics cultivation.

The defendants' main interest appears to have been related to the criminal case publicly known as the "Toyota Yaris", which was registered following the seizure at the port of Durrës, in June 2018, of 3.4 million euros in 'cash' hidden in two used cars imported from Belgium.

In connection with the incident, Klevi Çani, Edi Lika and Alban Mollaymeri were initially arrested, while cousins ??Elvis Vladi and Alfred Vladi were charged.

Six years later, in 2024, as a result of data obtained from the Sky ECC application, SPAK arrested Vlora prosecutor Aurel Zarka, lawyer Radovan Çela, Astrit Vladi - Elvis Vladi's brother - and declared the National Bureau of Investigation investigator, Eriona Daupaj, wanted.

The four defendants are suspected of having, in collaboration with each other, on several occasions offered and promised irregular benefits to exert influence over justice officials in 8 criminal cases, including the trial for the seizure of 3.4 million euros at the port of Durres./ BIRN
