Terrorism and serious crimes, SPAK will "filter" travelers entering and leaving the country

SPAK is expected to be one of the institutions that will be able to process the data of passengers entering or leaving Albania through air and sea transport.

The inclusion of SPAK in the list of competent institutions of this type has been proposed by the Ministry of the Interior in a law "for the collection, processing, transmission, storage, deletion, protection and guarantee of passenger information data in the Republic of Albania".

According to the legal draft, which is in the stage of consultation with experts, the processing of passenger data, for the purpose of prevention, detection, investigation and prosecution of serious crimes, or those related to "terrorism", will be able to be done by 8 institutions , including the Special Courts and the State Intelligence Service.

The bill aims to focus on a single authority in the State Police, the Passenger Intelligence Sector, the collection and use of passenger data.

The draft envisages that any passenger data, preliminary and reservation data, including information on ticket details, luggage, addresses, telephone contacts, up to reservation confirmation codes will be transmitted by transport companies to this sector.

Time limits are also provided for this, closely related to the scheduled departure time of the flight or cruise, or the moment when the boarding procedures have been completed and it is impossible for passengers to enter or exit.

According to the draft law, the Passenger Intelligence Sector, in accordance with the legislation on the protection of personal data, carries out international data transfer with EU member countries, with Interpol and Europol, within the framework of the operational cooperation agreement and with non-member countries of the EU when deemed necessary.

Referring to the draft report signed by the Minister of the Interior, Ervin Hoxha, its objective is compatibility with the legal standards of the European Union.
