The hearing for the Elbasan incinerator has been postponed until September 14, while only the lawyer of the Albtek Energji company remains to make the defense. This Thursday, Mirel Mërtiri and Stela Gugallja presented their conclusions through lawyer Klodian Skënderi.

The latter denied that his client committed the criminal offenses for which he is accused by SPAK, saying that he is not the owner of the incinerator.

"The prosecution body claims that the 'de facto owner' of Albtek Energy is Mirel Mërtiri. The term 'de facto owner' has no legislative basis and is not based on evidence. The sole partner of Albtek Energy is Strela Gugallja, while Mërtiri was employed as the technical director of the subcontracting company Integrated Energy. SPAK by labeling him as the de facto owner presumes that he has committed the criminal offense of corruption. There is no document, signature or proof that proves that Mërtiri is the owner of Albtek Energy.

On February 5, 2014, a waste management emergency was declared. The Municipality of Elbasan submitted the letter to the Ministry of Environment. There is no email from Mertiri before the official documents. All procedures have received the approval of the Council of Ministers. In the email, there is no moment where corruption is proven. "Mertiri is simply accused of the daily operation of 'Albtek', where the partner is his co-habitant and the mother of his children," said the defense.

SPAK's claim was that the difference between the preventive measures was in the amount of 5 million profit for the company. Lawyer Klodian Skenderaj presented the argument that the prosecution body did not take into account subcontracting costs, landfill maintenance costs, employee salaries and bank interest costs.
