Ministry of Economy: The Appeal Decision passes only one building to KAYO, the lease of "News24" until 2033

The Ministry of Economy, Culture and Innovation stated today that the lease contract claimed to be valid until 2033 by the company "Fokus Media News", refers to another property, with a different number and limits from the property subject to court decisions and that has not been transferred to "KAYO" sh.a.

So there are two different contracts, where in the first there is already a final decision and there is no signed contract, while for the second there is a contract until 2033, but which is a different territory.

MEKI confirmed today with an official reaction that this fact is confirmed by the official documentation of the cadastral register and by the survey plans, which clearly show that it is a matter of different property units.

"The company's claim that its lease contract has a term until 2033 is related to another state-owned property, different and without any legal or factual connection with the property passed to the state-owned company "KAYO" sh.a. In contrast, the property that has been transferred to the company "KAYO" sh.a. with the Decision of the Council of Ministers no. 158, dated 12.3.2025, was initially leased in 2002 for a term until 2022 and has been the subject of final court decisions, having the "Focus Media News" Company as an opposing party, the ministry says, among other things, offering transparency to anyone and appealing for the most accurate publication of information.

It is reported that the second property is also owned by the state and is located in the cadastral area no. 8170, property no. 10/304, with a land area of 13,922 m², near the former "Vehicle Spare Parts Plant" in Shkoza.

For this property there is another lease contract concluded in 2013 and amended with an annex in 2016 between MFE, today the Ministry of Economy, Culture and Innovation and the Company Panorama Group Sha., with a duration until 2033. And it is not this asset that is being transferred to the KAYO company, but the other one for which there is a final court decision.

Sources clarify that this building, for which the 2013 contract was concluded, is the one where News 24 exercises its main activity, where the studios, direction and premises of journalists are located. So, according to sources, television activity remains unaffected by the final decision of the Court of Appeals, which is related to the building blocked today and where mainly the administrative activity of the company takes place.

"The Ministry of Economy, Culture and Innovation, following the high public interest and clarifying the opinion on the claims presented by the Company "Fokus Media News" regarding the so-called continuity of the lease contract until 2033, announces the following:

The company's claim that its lease contract has a term until 2033 is related to another state-owned property, different and without any legal or factual connection with the property passed to the state-owned company "KAYO" sh.a.

The property in question is also owned by the state and is located in the cadastral zone no. 8170, property no. 10/304, with a land area of 13,922 m², near the former "Vehicle Spare Parts Plant" in Shkoza. For this property, there is another lease agreement signed in 2013 and amended with an annex in 2016 between MFE, today the Ministry of Economy, Culture and Innovation and the company Panorama Group Sha. with a duration until 2033.

Në dallim nga kjo, pasuria që i është kaluar shoqërisë “KAYO” sh.a. me Vendimin e Këshillit të Ministrave nr. 158, datë 12.3.2025, ishte fillimisht e dhënë me qira në vitin 2002 për një afat deri në vitin 2022 dhe ka qenë objekt i vendimeve gjyqësore të formës së prerë, duke pasur kundërpalë Shoqërinë “Focus Media News”.

Kontrata e qirasë e pretenduar si e vlefshme deri në vitin 2033 i referohet një pasurie tjetër, me numër dhe kufij të ndryshëm nga pasuria objekt i vendimeve gjyqësore dhe që nuk i është kaluar “KAYO” sh.a. Ky fakt konfirmohet nga dokumentacioni zyrtar i regjistrit kadastral dhe nga planet e rilevimit, të cilat tregojnë qartë se bëhet fjalë për njësi pronësore të ndryshme.

Çdo përpjekje për të paraqitur këto pasuri si të njëjta ose të lidhura, përfshirë referencat ndaj kontratave të tjera të qirasë, përveçse e pabazë është edhe një dizinformim nga ana e një media-je që duhet të tregojë të vërtetën. Asnjë interes material i pronarëve nuk e justifikon keqinformimin!

Pra janë dy gjëra e dy kontrata krejt të ndryshme dhe kjo e dyta nuk ka asnjë ndikim mbi vlefshmërinë, legjitimitetin apo ekzekutimin e vendimeve gjyqësore të formës së prerë që detyrojnë lirimin e menjëhershëm të pasurisë së kaluar nga Këshilli i Ministrave shoqërisë “KAYO” sh.a., për realizimin e objektit të saj të aktivitetit.

Ministria e Ekonomisë, Kulturës dhe Inovacionit rikonfirmon se veprimet për marrjen në posedim faktik të kësaj prone janë në përputhje të plotë me ligjin dhe me vendimet e gjykatave, si dhe se pasuria është e regjistruar qartësisht si njësi e veçantë pronësore, pa lidhje me asnjë pronë tjetër të dhënë me qira përmes kontratave të ndryshme.
