The Competition Authority is expected to open an investigation into the insurance market in Albania, placing this sector at the center of institutional attention due to doubts about the functioning of competition.
The Head of the Competition Commission, Denar Biba, has confirmed that the insurance market will soon be the subject of investigation, responding to repeated requests from the Parliamentary Committee on Economy, Finance and Employment, but without providing further details on the scope or duration of the process.
The focus of the discussions has been particularly on the compulsory motor third-party liability insurance market, a segment that has long raised questions about the real level of competition.
A draft resolution drafted last year by the Economy Committee, although not approved by the Assembly, called for a priority investigation of TPL and Green Card products. The document envisaged analyzing practices that may have influenced the restriction of competition and price fixing, as well as the manner of information exchange between market operators.
According to the draft resolution, the investigation should also include verifying the impact of this information exchange on the commercial behavior of insurance companies, as well as identifying any mechanism that could lead to price coordination or market sharing.
Another element raised is the possible existence of digital platforms or algorithms that could be used to coordinate prices and distribute revenues between companies, which if proven would constitute a serious violation of competition.
On the other hand, the Financial Supervisory Authority has maintained a more reserved stance. In a previous statement to Monitor, the AFSA assessed that the compulsory motor insurance market exhibits an acceptable level of competition, emphasizing that the regulated and standardized nature of this product affects the way the market functions.
According to the AFSA, despite these characteristics, competitive pressure exists between insurance companies, however, the final assessment of anti-competitive behavior remains the exclusive competence of the Competition Authority.
This is not the first time the TPL insurance market has come under scrutiny. It has been the subject of investigation in the past, but the issues identified have been addressed mainly through recommendations to the Financial Supervisory Authority.
The new investigation is expected to provide a clearer picture of the real functioning of this market and whether the practices followed by operators have violated competition and consumer interests./ skyweb.al
