Prime Minister Edi Rama and Minister of Justice, Ulsi Manja, are presenting today the package of legal measures for the protection of property and territory.
This was previously announced by the head of government after the action to free up public spaces.
Ramma said that the package was worked on by a group of experts, while warning that the "offensive" will probably last the entire mandate "to stop without return any inspiration to build without permission."
Rama said that this package is not perfect, but it gives the authorities new instruments to defend the territory. He said that the offensive will last as long as necessary.
"Just as nothing is perfect, this package is not perfect either, but it is a set of measures that will give us the opportunity to have new instruments in hand to defend the territory, starting from the final success of an offensive that will last as long as necessary, perhaps throughout the new mandate, to the irrevocable ban on any inspiration to build without permission and to continue with a series of other aspects, to the protection of the authorship of architectural projects that during this entire period of time, since free enterprise began to build in Albania, have been deformed and sometimes raped in their form by the intervention of builders," said Rama.
Manja: We will create a blacklist for illegal construction!
Minister of Justice Ulsi Manja, at the conference where the package of legal measures for the protection of property and territory is being presented, stated that a blacklist will be prepared with all the names of developers, builders and even administration employees who violate the law.
"Regarding the strengthening of control over unauthorized construction, the amended law provides for the drafting of a blacklist. We will have a list of developers and individuals who violate the law. It will not only be developers or builders, but also administrators and final beneficiaries. No one will escape this blacklist. They used to escape the law by changing the name of the company or administrator. They are excluded from obtaining construction permits for five years. Of course, in the concept of territorial development, cooperation in this specific case is mandatory according to the law. They will be monitored in real time, " said Manja.
He added that penalties are also foreseen for administration employees, and their violations have even been raised to the level of a criminal offense.
"It will be considered a very serious violation and will result in dismissal, and the employee will be banned from working in public institutions for a period of 7 years. The category of public employees is very broad, it includes the entire category of public servants who have specific competencies and duties in the development of the territory," he said.
Manja said that territorial protection reform is an urgent necessity. He emphasized that the new legal package proposed by the government for the protection of property and territory is a step towards a new development model.
"It guarantees equality in the development of shared public spaces, legal certainty for citizens and builders, and respect for our natural and cultural heritage," he said.
Manja said that the legal package aims to protect the territory through administrative and criminal measures.
"The package of legal measures that we propose today aims to protect land, territory, nature and the environment through administrative measures and criminal measures that come as a reflection and need of the changes we have made with the package of administrative measures," said Manja.
But what does this package aim to do?
"Stop the phenomenon of unauthorized construction by strengthening legal mechanisms during construction implementation. It starts in the early stages of construction, when the construction site is opened, until the facility is handed over with a certificate of occupancy."
To liberate and reclaim public spaces by turning them into a function of community life and balanced urban development.
To protect natural resources and the environment as an inalienable national asset.
Strengthen transparency and institutional control so that citizens have confidence that the country's territory is being administered responsibly and in real time.
To promote tourism and the green economy by providing free and clean spaces for visitors and citizens and by contributing to the creation of a green fund.
"Prohibiting abuses by disregarding architectural projects approved by the responsible bodies," said Manja.
