The groups that are framing the draft law on prison amnesty have also sent a request for opinion to SPAK .

The letter sent to SPAK , as well as other justice actors, including the General Prosecutor's Office, includes the category of offenses that will be amnestied, for which a reduction in sentence will be applied, closure of criminal proceedings, as well as prohibitive criteria.

We have expressed the opinion that other criminal offenses that are not within the competence of SPAK, but that may be closely related in the form of proceedings related to the criminal case within the competence of the Special Prosecution Office, should not be included in the law on amnesty," the Special Prosecution Office stated.

730 prisoners left their cells under the 2024 amnesty and 1,600 others received reduced sentences. The official forecast announced by the Ministry of Justice for the next amnesty estimates that around 380 prisoners could leave their cells.

However, there is no concrete list yet.

The draft distributed to institutions mentions that the proposed beneficiaries are male prisoners sentenced by a final decision to imprisonment for up to three years or alternative sentences and fines, while the sentence must have become final by December 31, 2025, as well as those convicted who have three years left in prison by the date the draft law enters into force.

Also women sentenced to up to four years in prison.

The reduction of the sentence to one year is being discussed to be applied to women imprisoned for up to one year and also one year for men.

Again, those convicted of murder, life sentences, and a specific category of those convicted by the anti-corruption court are expected to be excluded from the amnesty.

Meanwhile, the draft also proposes to exempt from criminal prosecution reports filed this year that are punishable by a maximum of two years in prison, while the draft law also affects convicts on probation.
