Former prosecutor of the General Prosecutor's Office, Adnan Kosova, wins the battle in the Strasbourg Court.
After examining the Kosovo case, Strasbourg stated that “the applicant’s dismissal did not appear to be proportionate to the legitimate aims pursued.”
The Court considered that, if Kosovo so requests, it would be appropriate for the Vetting procedure to be reopened and the case to be re-examined in accordance with the requirements of Article 8.
Albania must pay Adnan and Kosovo 6 thousand euros for non-pecuniary damage and 5 thousand euros for costs and expenses of the procedure.
Adnan Kosova was dismissed from office by decision of the Special Appeals Commission, otherwise known as the second level of vetting, a decision that has already been considered disproportionate by Strasbourg.
Kosova is a career prosecutor and has served in the Serious Crimes Prosecution Office since December 2004 and was also the head of this institution. At the time of his removal from the justice system, he was serving as a prosecutor at the General Prosecutor's Office.
