Lampedusa: Refugees attempting to illegally enter Italian shores

The Constitutional Court decides today on the agreement for the accommodation of Italian immigrants in Albania. Legal and security experts consider it dangerous to violate the international principle of extra-territoriality.

The highest judicial institution in Albania is expected to have its say and decide on the fate of the much-debated Rama-Meloni agreement for housing at least three thousand refugees who are caught trying to enter the Italian coast illegally, in two centers that will be erected in the north-west of the country.

30 MPs of the opposition consider the agreement between the two countries as a violation of the Constitution of Albania and international law. Since the signing of the agreement in Rome last November, local and foreign experts expressed skepticism about an agreement that gives Italy the full right to manage the migrant crisis, using a foreign territory of a neighboring country. like Albania, which is not a member of the European Union.

Violation of laws, breach of security

According to Dorian Matlië, lawyer and head of the "Res Publica" legal center, the first aspect concerns the abuse of the principle of extra-territoriality. "In this particular case, Albania will be part of the Italian state, and no longer of the Albanian state . Which means that the Italian legislation will be applied. Everything that has to do with civil rights, the treatment of criminal offenses that may occur there, everything will be in accordance with Italian law.

This principle is usually only applied to cases of embassies, which are small, controlled territories with people who are accredited by their country, but is not used to bring in large numbers of refugees, when you have no information about what contingent they are. , because there can be very good people but also people from the criminal contingent" - he analyzes for Deutsche Welle.

According to Matli, this can also be considered "lost land". "The other state turns that territory into a camp and does whatever it wants with it. It is said that he gives that territory with a concession, but a concession without a deadline", says the legal expert Matlija.

Skepticism and uncertainty

The expert on security issues, Arjan Dyrmishi, at the same time head of the "Center for the Study of Democracy and Governance", also views the agreement and its implementation with skepticism. "This capacity of 3 thousand people that will be raised, what level of population will this? Will there be overcrowding? What will be the contact with the outside, because it will be in Albanian territory. There will be a need for supplies, food, etc. It will be like a kind of prison, but those people are not prisoners, they will just be sheltered here.

Their relations with the territory where they will settle are inevitable and these remain unclear. Of course, the agreement states that Albania will secure the perimeter, but this is only about non-escape. But we have seen that even in high security prisons, incidents happen", says Dyrmishi to DW.

Precedent for other European countries?

The law expert, Matlija, is full of hope that the Constitutional Court will annul this agreement, because otherwise opening the way for its ratification in the Assembly would set a dangerous precedent for the future as well.

"If the Constitutional Court does not put a stop today, then this will turn into a very bad precedent, which would bring a greater number of refugees tomorrow, expanding more and more this taking of land, territory, bring perhaps the most problematic ones to Albania. And considering that the crisis of European immigrants is getting deeper and deeper, this means that the need of other European countries, not only Italy, will be increasing".

"I don't think that this agreement would make Albania attractive for agreements with other countries. I think that the current problem that the countries of the European Union are facing is big. It has put the political structure of these countries under a lot of pressure. countries and decision-making within the EU in terms of migration", concludes Dyrmishi.
