REL: The unsuccessful fight for the return of property in Kosovo!
Lubisha Cerovic

Lubisha Cerovic, a Serb from the village of Bellopojë in the municipality of Peja, has been trying for over 20 years to return his family's land, which he says was sold to him illegally after the war in Kosovo , while he and his family had moved In Serbia.

He did not manage to do this even after a decision of the Kosovo court in his favor.

He says that the family's land on the Pejë-Deçan main road was sold through a false authorization, in the name of his grandfather, who was dead at the time.

The mayor of Peja, Gazmend Muhaxheri , says that there are several similar cases within this municipality.

Property issues related to ethnic tensions in Kosovo were also mentioned in  the latest report  of the US State Department on human rights of 2023,  published on April 22.  In particular, this report states that some Kosovo Serb representatives claimed that government institutions "failed to execute court decisions in favor of Kosovo Serbs, especially in property disputes."

Kosovo Albanians also have problems with occupied property, especially those in the divided city of Mitrovica.

Among them is Shyqri Celiku, who for 25 years failed to restore his apartment in the northern part of Mitrovica.

According to a report by the international human rights organization, Human Rights Watch (HRW), published in 2001, the scale of destruction of civilian property by Serbian government forces in 1999 was very large.

The report cites a survey by the Office of the United Nations High Commissioner for Refugees (UNHCR), according to which almost 40 percent of all residential houses in Kosovo were severely damaged or completely destroyed.

"As long as I'm alive, I will try to return the earth"

In June 1999, after the NATO bombing campaign, Serbian forces were withdrawing from Kosovo.

In the multi-ethnic areas there was increased tension between the Serbian and Albanian communities.

In that June, in the village of Bellopojë in Peja, in the western part of Kosovo - inhabited at that time by a majority of Serbs - Lubisha Cerovic together with his family left for Serbia.

They left behind their house in the village of Bellopojë, as well as a land of about 54 acres on the Deçan-Pejë road, which they had used for planting.

The house and land belonged to Milleta Cerovic, Lubisha's grandfather, who died in 1997.

On the other hand, Agron Kelmendi did not comment on the Court's decision that the authorization was forged or if he knew Milleta Ceroviqi.

"I do not know. I don't remember, it's been a while. Freely... in Court you get it all. Those civil procedures have been completed," he told Radio Free Europe.

Kelmendi added that the authorizations were brought by Miroslav Zonjic and that they were brought from Belgrade.

He said he feels cheated in the process, not wanting to comment further.

Radio Evropa e Lire has addressed the Basic Prosecutor's Office of Peja with the question of whether Kelmendi has ever been prosecuted for forgery. So far, this institution has not responded.
