Prime Minister Albin Kurti, during his address at the Government meeting, confirmed that Kosovo's admission to the Council of Europe is conditional upon the formation of the Association of municipalities with a Serbian majority.
Kurti said that there are several European capitals that are demanding that the draft statute of the Association proposed by the Europeans be accepted by the Government and sent to the Constitutional Court for evaluation.
"In these last weeks, we faced a new condition which has nothing to do with the standards of membership in this organization. After the condition that a judgment of the Constitutional Court (the lands of the Monastery of Deçan) be implemented, a condition which is included in the pillar of the rule of law within the Council of Europe, we heard that there are capitals that are now conditioning the finalization of the membership process with sending a document (draft statute of the Association) to the Constitutional Court of Kosovo".
Kurti stated that they requested that the draft statute become part of the package of the Brussels basic agreement and the Ohrid implementation annex and be signed to become legally binding and enforceable, but that was rejected by Serbia.
"This document brought by Lajçak and the emissaries of QUINT was not accepted on October 26 of last year. Kosovo has offered to become part of the basic agreement and sign it to make it legally enforceable, but was rejected by Serbia. If the agreement package was accepted and signed in Brussels on October 26, 2023, only then could it be sent to the Constitutional Court of Kosovo. The draft statute of Lajcak and the QUINTI envoys failed to materialize and was rejected".
He said that only with a signature could this document be accepted and sent to the Constitutional Court. Kurti insisted that they did not accept the draft statute and as such this document can simply be called "non paper".
"The Government of Kosovo cannot send documents that it has not accepted and are not official to the Constitutional Court, this request to us was and remains absurd"
Prime Minister Kurti recalled that the instances of the Council of Europe had rejected three times during the voting process that the Association should become part of the conditions for membership. He expressed his disappointment that this conditionality is coming from countries that have supported Kosovo.
"Obstacles to membership in this organization were considered by the states that have not recognized the Republic of Kosovo until now, but they never thought that democratic states that have been and continue to be supporters of Kosovo would become an obstacle. development and democratization and earlier they were by our side for liberation and independence".
The Prime Minister said that "the Government has done everything in its power to fulfill all obligations and that they had also pledged in a letter that they would fulfill all the obligations of the dialogue with Serbia after the accession". According to him, they cannot do more than that.
Kosovo applied in 2022 to join the Council of Europe and, last month, the Parliamentary Assembly of the Council of Europe recommended that Kosovo be admitted to the organization. KiE - leader in Europe for human rights can vote for the admission of Kosovo on May 16.
