Germany is modernizing the citizenship law. The spokesman of the interior ministry, Maximillian Kall, said on Friday in Berlin, at the regular press conference of the German government, that "the draft law is almost ready". What are the anticipated changes?
Citizenship after five years
While until now, to get a German passport you must have lived in Germany for at least 8 years with regular documents, with the new draft law you can get citizenship after five years. In some special cases, good integration in society and work, even after three years. Volunteering also pays off.
Citizenship without an exam for the elderly
Even for first-generation immigrants, over 67 years old, who have been living in Germany for decades, but do not easily pass the language test, there will be concessions. It will be enough for them to "be able to understand themselves in German".
Children born in Germany can also automatically obtain German citizenship if one of the parents has been living regularly in Germany for five years.
Exemptions from citizenship remain the same
Many rules have remained the same in the draft law: Persons who have committed criminal offenses, either in Germany or in their own country, or who have shown unconstitutional attitudes in the past, will be excluded from naturalization.
It will also be difficult for people who cannot prove their identity, who have a temporary residence permit or who are with Duldung.
Even those who receive social benefits from the state have few chances. There are exceptions for these only in exceptional cases.
Dual citizenship is allowed
Until now, to get German citizenship you had to surrender your home country's citizenship. This rule is expected to be removed.
According to the draft, cited by several media, the acquisition of citizenship in the future will be granted only to persons who have not committed criminal offenses, neither in their country nor in the current country. And that are not against the constitution.
Germany is a country of immigration
The main principles for a reformed citizenship law were laid out in the coalition agreement between the Social Democratic Party, the Green Party and the Liberal Party, in November 2022.
The interior ministry spokesman said that "the federal government sees Germany as a diverse country of immigration, as a diverse immigration society, and is therefore modernizing legal norms, especially in the area of citizenship law."
The opposition criticizes
Germany's conservative opposition has met with anger the news of the new bill.
The vice president of the opposition parliamentary group, CDU/CSU, Andrea Lindholz, told the "Bild" newspaper that apparently, "the coalition intends to put the German passport on the antiques market."
Bavaria's interior minister, Joachim Herrmann, expressed outrage at the center-left coalition's plans. He called them "indisputable". According to him, the liberalization of the naturalization law reduces the motivation of immigrants for integration and rewards the lack of will to clearly identify with Germany.
Approval is expected to be difficult
The topic of citizenship has been one of the most sensitive topics for the party electorate in Germany. As of now, the bill has caused a lot of critical comments on social media.
But the German newspaper "Frankfurter Allgemeine Zeitung" also criticized the draft law and called it "depreciation of German citizenship" and "neglect of German interests".
The possibility is not excluded that, after the approval by the government cabinet and the Bundestag, it will be blocked by the Lands in the Bundesrat, or will need the engagement of a mediation commission, until it is finally approved. But for now, according to government sources in Berlin, he has left the ministries and has been handed over to the chancellery for review./DW
