The Justice Department is considering how to drop the charges against Trump

US Justice Department special counsel Jack Smith is considering ways to end two federal criminal cases against President-elect Donald Trump before he takes office, a department official familiar with the matter said.

Continuing impeachment proceedings against Trump would violate a longstanding policy against prosecuting sitting presidents, and with two federal filing deadlines approaching, Nov. 15 and Nov. 21, the department's decision on how to drop the charges could come in a few weeks, writes USA Today.

Trump faces charges that he tried to steal the 2020 election and prevent Congress from counting the Electoral College votes on January 6, 2021.

Trump has also been accused of illegally keeping classified documents after he left the White House.

District Judge Tanya Chutkan will decide whether Trump has immunity from the charges, according to the Supreme Court's decision in July.

Trump insists he cannot be prosecuted for actions related to his first term as US president, including the January 6, 2021 attack on the Capitol by his supporters
