DECISION of the KKTU

A sudden decision, in January of this year, allows municipalities to issue building permits of up to 250 square meters within the coastal strip. The local government has even taken it upon itself to approve construction additions to existing permits or to "legalize" and complete the documents of permits issued years ago, which have been delayed.

According to the KKTU decision, researched by VoxNews , it turns out that some municipalities that also administer coastal areas will have free rein in small constructions, such as kiosks, or to "help" those who have occupied land on the beach to do so with documents. However, they can decide that the constructions can also change functions, regardless of the permission obtained in the past.

The decision is a small "amnesty" by the government for the coast, attempting to pave the way for privatization or even exploitation.

The above decision was taken on January 28, 2025 by the National Council of Territory and Water. This council has taken a decision number 62, for "determining the procedures to be followed by the territorial development authorities for the review of applications, within the coastal zone".

"This council, upon the proposal of the Territorial Development Agency, decided that within the coastal belt, local territorial development authorities are allowed to approve development permits for construction, demolition, reconstruction, repairs, additions, project changes during construction, changes in development entities and changes in activities, functions, deadline extensions and any other permits mentioned in the Territorial Development Regulation," the decision states.

According to it, the local government should carry out administrative procedures for all relevant acts or documents, up to the issuance of the certificate of use, only for these exceptional cases;

A) New buildings with a total area of ??up to 250 m2.
B) Reconstructions of existing buildings, permission for which has been granted by the local territorial development authorities
C) Additions to existing buildings
D) Local public infrastructure networks, water supply networks, collection and treatment of used water, which are laid within the territory of a local self-government unit
E) State buildings on state property transferred to local government units
F) Buildings damaged as a result of a natural disaster, public and/or critical infrastructure, as well as new constructions in areas damaged by a natural disaster
G) Fiber optic networks
H) Surrounding walls.

Facsimile: Procedures are carried out by the local government and approval is given by the KKTU within 10 days.

The decision stipulates that territorial development authorities must follow the procedures in accordance with the conditions and rules set out in the Territorial Development Regulation for all cases mentioned in point 1.

According to it, the local authority sends the request for conformity to the Territorial Development Agency electronically, along with the accompanying documentation.

The Territorial Development Agency then responds to the local development authority electronically via the electronic permitting system within 10 working days. After receiving the ARD's notification of the conformity of the proposed development, the local authority follows the procedure for approving the relevant permit.

Point 3 of this decision states that for all other cases not included in point 1 of this decision, the competent decision-making authority within the coastal zone is the KKTU.

Meanwhile, requests for the performance of works based on a "preliminary declaration for the performance of works" will be submitted and reviewed by local territorial development authorities, with the exception of requests for beach stations that are the subject of a construction permit from the KKTU.
