
The head of the Public Procurement Commission, Jonaid Myzyri, has been officially taken under investigation by the Special Prosecutor's Office. He has "visited" SPAK 3 times within a short period of time, while during this time he was aiming for another mandate at the head of the institution he leads.
Problems with his job have led to him being investigated for serious abuses. According to information provided by VoxNews, Myzyri is suspected of abusing his position in the mosquito spraying tender. The small insects look like they are about to "eat the head" of the KPP head.
According to documents researched and analyzed by VoxNews, Myzyri has not implemented a final decision of the Administrative Court of Appeal. He has overstepped the courts, giving himself attributes that do not belong in the judicial system.
The documents specify that in 2023, a tender was held with several lots for the desiccation of urban and coastal areas, starting from Velipoja and ending in Ksamil. There were several companies in the competition, but major violations were found in the lots of Fier and Vlora.
In Fier, there was lot 5 with the object "disinfestation service in coastal and urban areas, Fier District", with a limited fund of around 220 thousand euros, developed on June 13, 2023 by the State Agency for Centralized Procurement.
Several firms participated in this tender, with the winner in the APP being the firm “Egian”. But this is where the “game” of Myzyri begins. The losing firms appeal to the KPP, which decides to disqualify all the firms that offered the least and instead gives the tender to the firm “NRG”, which offered the most. In fact, the KPP decision states that the firms that offered the least were disqualified because they falsified some documents!
Really?! Is the KPP an investigative or judicial body? Until then, and even today, there has been no decision by law enforcement bodies determining that documents have been falsified.
One of the firms that lost in the CPC, namely "Egian", sent the case to the Administrative Court of Appeal. On July 25, 2024, the Appeal decided to accept the lawsuit and annul 2 decisions of the CPC.
Written in black and white, after this decision the Public Procurement Commission should have taken immediate action. But did it? Of course not, since it had ordered the winner of the tender to sign the contract and continue the procedure.
But, not only did he not implement it, but Myzyri categorically refused to act!
The above document is scandalous, for all people of justice. An institution openly refuses to implement a final court decision. A frightening arrogance from a leader, who openly challenges the entire system.
In a letter signed by the head of the Public Prosecution Service himself, Myzyri said that he had been informed of the decision of the Administrative Court of Appeal, but had appealed to the High Court to suspend it.
"Regarding the above, we inform you that, after the Administrative College of the Supreme Court expresses its opinion on the request for the suspension of the execution of the decision, the Public Procurement Commission will continue to follow further procedural steps," he writes.
A blatant abuse of powers, since the decisions of the Appeals Court cannot even be discussed, let alone not implemented. But Myzyri, with his connections, not only does not implement them, but acts "strong" by continuing with his own, at least until SPAK intervenes.
