Shkodra Prosecutor, Blerta Hamza , has received a severe "slap" from all levels of justice, in connection with the property investigation against Ago Gjolaj, the owner of the "8S2" energy drink .

In April 2024, this prosecutor, with a highly suspicious letter from the Shkodra Police, after which there may be other clans and with only 4 days of investigation, decided to seize the assets of the Gjolaj family, without having any detailed information, blocking the legal activity of this family for many years, in Malësia e Madhe or even in Tirana.

Initially, the first blow to prosecutor Blerta Hamza came from the Court of Appeal of General Jurisdiction, Tirana, which decided to unblock the seized assets without any evidence. Then, the second "slap" came from within the institution of the Shkodra Prosecution, where the head of this prosecution body, Albert Murçaj, decided in September 2025 to address the Shkodra Court to cease the investigations.

Also, at the end of September last year, Judge Egla Mirashi accepted the prosecution's request, dismissing the case "since the assets are legal."

On September 5, 2025, the Chief Prosecutor of Shkodra, Albert Murçaj, according to documents researched by Vox News, sent a request to the First Instance Court of General Jurisdiction of Shkodra. According to him, this concerns criminal property proceedings with number 01, initiated by prosecutor Hamza on April 11, 2024, registered on the basis of a referral from the Shkodra Police, with the aim of verifying the assets of citizen Ago Gjolaj and his family members.

"From the referral made by the Shkodra Local Police Directorate, which was informed by the Interpol National Office in Tirana that the Montenegrin authorities are investigating the Albanian citizen Sonjela Gjolaj for the criminal offense of money laundering. This citizen, on April 12, 2018, signed a contract for the purchase of a luxury yacht worth 300 thousand euros with the Montenegrin citizen Sase Jakica, who is involved in criminal activity and money laundering ," the document stated.

According to the prosecution, a full investigation of the Gjolaj family's assets was conducted, and information was requested from the Shkodra State Cadastre Agency.

"It has resulted that there are no registered real estate properties in the name of citizen Ago Gjolaj and his family members. A social economic building with an area of ??2,592 m2, which is owned by the company 'B.M' shpk, is in the process of legalization," the indictment states.

According to her, it has resulted that from the investigations and verifications carried out, citizen Ago Gjolaj and his family members do not have assets that are disproportionate to the level of their income over the years or the profits made from legal sources declared by them.

"On the contrary, all their assets are regularly declared, with legal sources and fully justified. The amount of declared assets is as follows; the verified net income of citizen Ago Gjolaj and his family members for the period 2012-2023 is 1.2 billion lek," the prosecution continues.

He further adds that the entire property declared by the subject Ago Gjolaj and his family members is fully justified and as a result there is no room for sequestration and this proceeding should also be dismissed, wrote prosecutor Albert Murçaj.

Finally, it requests the court to terminate the investigations and to definitively return the seized assets cited above and subsequently returned to the subject Ago Gjolaj to their legal owners according to the decision of the Court of Appeal of General Jurisdiction, Tirana.

On September 30, 2025, the Shkodra Court of General Jurisdiction decided to accept the request of the Shkodra prosecution.

In the end, Judge Egla Mirashi decided to "discontinue property proceedings number 01, dated April 1, 2024, regarding citizen Ago Imer Gjolaj."

The decisions of several levels of the prosecution and the court are a serious blow to prosecutor Blerta Hamza. She seized the family's assets based on a criminal proceeding initiated seven years ago on charges of laundering the proceeds of crime.

It took the prosecutor four days to discover that the business in question, one of the largest in Albania in the field of distributing energy drinks and other products for which it enjoys exclusive distribution rights, was used to launder the proceeds of crime.

Prosecutor Blera Hamza reached this conclusion without first questioning anyone from the company, not even the businessman himself, Ago Gjolaj. She did not refer to any financial data from the balance sheets of businessman Gjolaj's company, which were public and easily accessible at the National Business Center.

She did not first prove the source of the 300 thousand euros, because if she only looked at the Central Bank, she would understand that the Gjolaj family firm had raked in tens of millions of euros before purchasing the ship in Montenegro.

But, the most scandalous thing is that Hamza wrote that he bought the vessel from a person under investigation in Montenegro. Is it the buyer's responsibility to seek evidence of a criminal record for the seller? Especially since the transaction was made legally, without hiding a single penny.

The damage to the image of Ago Gjolaj and his business in partnership with Bavaria Group is considerable. It now remains for the dormant institution of the High Inspectorate of Justice to launch investigations against prosecutor Blerta Hamza, to uncover the background to the attack on "BM Group".
