Criticisms of the Helsinki Committee, those of the Ministry of Justice and up to the concerns of the European Commission on the respect of human rights and the imposition of coercive measures proportional to the accusations leveled against Albanian citizens, seem to have gone from one ear to the other. they came out.

Special prosecutors and judges continue to be strict with citizens and small officials, but soften when it comes to high-profile politicians, for whom they cannot even find the courage to comply with mandatory security measures. as in the case of Sali Berisha.

The application of the two standards by SPAK was reinforced in the last case of 15 arrest warrants issued within the framework of the investigations for the Tirana incinerator. Jetmir Llapaj, an official of the National Business Center, was among the names that SPAK asked for the security measure of arrest and imprisonment.

Llapaj is accused of abuse of office, a lighter charge than that of Sali Berisha. However, SPAK demanded the security measure of arrest and imprisonment for him, while Berisha was assigned an obligation to appear. However, the court rejected SPAK's request and set a house arrest measure for Llapaj, since the latter had attempted suicide.

However, the court upheld the security measure of arrest and imprisonment requested by SPAK for Namik Simixhiu, also a pensioner like Sali Berisha today.

This is not the first time that SPAK's extreme measures risk causing tragedies inside the cells. Even the case of Enver Sheshi, arrested for the Fier incinerator and who tragically died in custody, is still fresh, without yet appearing in court.

Deaths in detention rooms for charges that are not related to murder, drugs, or terrorism in Albania come as news only from countries like Russia, Iran, or North Korea, but in no country of the European Union, or candidates for EU membership. such as Albania.

Therefore, in order not to repeat another tragedy like that of Enver Sheshi, the time has come for SPAK to reflect and apply alternative coercion measures, such as mandatory appearance, house arrest, or even property guarantee.

These forms are also among the recommendations that the Parliament of Albania submitted to the special prosecutor's office, as well as in the reports of the Ministry of Justice.
