The draft law on the Bank of Albania has sparked discussions in the Laws Committee, where at its center was the possibility of arresting the Governor for criminal offenses related to the exercise of his duties.

Article 72 of the draft law provides protection from prison arrest, house arrest and other coercive measures, when the charges are related to the function of the Governor.

According to the first deputy governor, Holta Zaçaj , this provision aims to guarantee the independence of the institution and avoid possible pressures on it.

Zaçaj explained that, in cases where the criminal offense is not related to duty, such as a road accident resulting in death, an arrest can be made. While for offenses related to the function, according to her, the connection of the accusation to the duty must be assessed.

"In Article 72, we have proposed that the arrest of the governor, if requested, must be verified if there is substantial evidence and if the criminal offense for which the arrest is requested is related to the duty. It is not immunity but a guarantee provision. The reason why the governor is protected is not because of his being governor, he is protected because of the element that he can function independently without the fear that one day a body of another power will come and prevent him from exercising his duty for one reason or another. The governor as a person is not protected. We protect the institution by protecting the governor," said Zaçaj.

Socialist MP Damian Gjiknuri opposed this provision, arguing that the Governor is being given guarantees that are not provided for in the Constitution. He warned that such protection could limit the activity of justice.

"We are giving the governor some guarantees by law that no one except the president has... this is excessive. We accept the failure of justice, the guarantee should be given by the court. It should be at the constitutional level, but not to be given a guarantee that is not determined by the constitutional norm. The only case where a bypass is made," said Gjiknuri.

The head of the Laws Committee, Ulsi Manja, also raised concerns regarding the difficulties the prosecution may encounter in collecting evidence if personal searches or those at the Governor's residence are limited.

"What about cases where the search of the apartment and the personal search limit the investigation? How will the prosecutor find the evidence?", said Manja.
