Lawyer Plarent Ndrecaj has addressed the responsible institutions with an official request for information and documentation regarding the transfer of Tirana Mayor Erion Veliaj from Durrës detention center to Fier Prison.

Ndreca accuses the General Directorate of Prisons of not making available the transfer act and the reasons that led to this decision.

The lawyer requests to be acquainted with the factual and legal reasons for the transfer, as well as to be provided with a complete copy of the documentary practice related to the decision-making and its implementation.

In particular, he requests the administrative act or decision ordering the transfer, the documents on which the decision was made, the justification for the necessity and proportionality of the measure, as well as official communications between the General Directorate of Prisons and the two penitentiary institutions.

In the letter, the lawyer raises the claim that the transfer was carried out against the client's will and without informing him of the act he ordered, questioning the legal basis of the action.

Due to the importance of the documentation for exercising the right to appeal, the lawyer requests urgent processing of the request and the immediate making of the documents available to Veliaj or his legal counsel.

Plarent Ndrecaj's full letter to the Prisons Directorate:

Addressed to: Dear Ms. Bodo

On 28.10.2026, at around 11.00, my client Erion Veliaj was transferred from the Durrës Penitentiary to the Fier Penitentiary, without making available to me, despite my and my client's requests, the act ordering the transfer and the concrete reasons justifying it. Against the will of Mr. Veliaj and without being informed of the act on the basis of which this transfer took place, the transfer took place not by force of a legal act, but without a legal basis.

In these circumstances, I request that the factual and legal reasons for the transfer be made known to me, as well as that I be provided with a full copy of all documentary evidence related to its decision-making and execution, including in particular:

The administrative act or decision ordering the transfer, along with the relevant justification.

The proposal, request, report or any other document on the basis of which the transfer was initiated and decided.

Documentation containing the concrete factual and legal reasons for the transfer, as well as assessments of the necessity and proportionality of this measure, if administered.

Official acts and communications between the General Directorate of Prisons, Durrës Penitentiary Institution and Fier Penitentiary Institution regarding the transfer.

Documentation proving Mr. Veliaj's notification of the transfer decision, as well as the acts documenting its implementation.

This requirement aims to enable full familiarity with administrative decision-making, verification of its legality and effective exercise of the right to challenge it before the competent authorities.

I request urgent processing of this request, given that the requested documentation is directly related to the possibility of exercising the right to appeal.

The information and documentation should be made available without delay to Mr. Veliaj at the Fier Penitentiary Institution, or his legal counsel, enabling him to familiarize himself with the practice and obtain the relevant legalized copies.

If any document does not exist or is not available from your institution, I request that this be expressly confirmed in writing.

In the event of restriction of access to any part of the documentation, I request that I be notified in writing of the legal basis and specific reasons for the restriction, making the rest of the documentation available to me.
