Through an instruction published in the Official Gazette, the Council of Ministers has approved the Acts that will be used to transfer to the ownership of the users the additional state surfaces which in practice are unusable. It is about those surfaces which the law recognizes as servient properties, in addition to plots obtained through AMTPs, which are owned by the owner of the main property and which, due to their size or configuration, cannot be used independently.
In the instruction, the models and content of the acts of transfer of ownership for additional state surfaces and service property, which are sold to entities, are defined, according to the rules defined in the Law "On Completing Transitional Processes of Ownership in the Republic of Albania".
The decision-making on the transfer of ownership of the additional state surface and service property will be carried out by the State Cadastre Agency (SCA) after the completion of the initial registration procedure, or the improvement/updating of the cadastral area, as well as the surface area.
After the request of the interested entity, ASHK starts completing the act of recording on the ground. It will contain the legal basis for issuing the administrative act and the type of surface for which the on-site recording is being carried out, as well as the generalities and identifying data of the entity that effectively owns the on-site, additional surface or service property. There will also be recorded the data on the surface of the land according to the graphic measurements in the field; the cadastral area and the number of the main property according to which the surface of the additional state property or service property lies, together with the data of the owners of the limiting plots.
The act of evidence on the ground will also be accompanied by the settlement plan, without which the subject entities will be provided with a property document by the state Cadastre Agency.
