Sky Ecc evidence, personal jurisdiction and territorial sovereignty in French

France has historically built a normative identity as the founding state of the modern doctrine of human rights, positioning itself as the guarantor of the principles of the Declaration of 1789, the European Convention on Human Rights, and the rule of law as a universal value.

This self-positioning does not find uniform reflection in its contemporary criminal practice, especially in the field of wiretapping and cross-border data collection.

But, it seems that the wind is starting to change direction! Recently, the French Court of Cassation, Criminal Chamber, with the decision of December 2, 2025 (Appeal No. 25-81.132) gives us a clear jurisprudential reference for the administration of data (computer) evidence. The Court finds that the procedural use of geolocation data collected outside French territory, without the authorization of the relevant State, constitutes a violation of the rules of public order related to State sovereignty. Referring to Article 230-32 of the Code of Criminal Procedure, the Court emphasizes that any party has the right to challenge the legality of a real-time geolocation measure which, despite the fact that the interception procedure was initiated on French territory, but in violation of the fundamental principles of sovereignty, continues on the territory of another State.

The Court further explains that such invalidity is closely linked to the guarantee of public order and that it exists regardless of whether the defendant is the holder of the computer device (the mobile phone emitting the data) that was intercepted or whether he claims a direct violation of his private life, even when he is not the user of the computer device himself but has been associated with the real user. Notwithstanding this, the violation of territorial sovereignty, in itself, is sufficient to compromise the legality of the procedure, and the admissibility of the evidence.

This reasoning is legally coherent and in line with the fundamental principles of public international law. But this very rigor highlights a structural contradiction when compared to the practice of the French authorities in matters such as the operation to dismantle or hack the SKY ECC application.

The success of these lawsuits will demonstrate that in France, just as human rights and procedural principles are universal, so are standards of legality. Otherwise, we are not dealing with the rule of law, but with its selective application – a practice that contradicts the very narrative on which the normative legitimacy of the modern European state is built.

In relation to Albania, if the French judicial authorities continue with the selective application of the norms, our Courts must give way to the debate on the admissibility and legality of the "Sky Ecc evidence", otherwise the processes underlying this evidence are clearly in violation of the Constitution and the European Convention on Human Rights.
