The Prosecutor's Office of Tirana has issued an arrest warrant for two architects in Tirana, after discovering a fraud scheme to build without permission in Tirana.

According to the investigations of the prosecution, architects Armando Prelezi and Klevis Bregu have applied for a construction permit in the "online" section "E-permit", but the constructions were carried out in another location.

The prosecution says that by verifying through "Google Maps", it has managed to prove that the construction was not carried out in the area for which permission was given, but was built on forest land that is owned by the Municipality of Tirana.

It is here that the name of the businessman from Elbasan, Gani Moka, appears on the scene, the latter turns out to have signed a lease contract with the Municipality of Tirana for the use of the surface from the forest fund.

Gani Moka is not unknown to the public. In 2021, he was tried to be blackmailed and held hostage by some people, who demanded 20,000 euros. Moka was traveling with one of his employees near Peqin, when the perpetrators stopped him and threatened him, trying to trap him as if he had had sexual relations with his employee, and then blackmail him.

"Citizen GM, administrator and sole partner of the entity Certi Ë South Balkans, has signed a lease contract on 14.04.2021 with the Parks and Recreation Agency for the area of ​​2000 m2, which is part of the forest fund, plot 1/a, for which the corresponding acts were compiled, finding that some of the structures with iron and concrete as well as the surrounding wall are positioned on an area of ​​the forest fund which has been put to use", the prosecution informs.

M. D., i cili nuk rezulton të ketë bërë aplikim për ndërtimin e paligjshëm, por ka pretenduar se ka ndërtuar objektin e konstatuar bazuar në lejen e ndërtimit nr Nr. K-10349/2.

NJOFTIMI I PLOTË:

Prokuroria Tiranë kërkon ‘Arrest në burg’ për dy arkitektë për Veprën Penale ‘Falsifikim i dokumenteve’, sekuestrohen pronat

Prokuroria pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm, Tiranë, ka regjistruar procedimin penal nr.1285, të vitit 2023(i bashkuar), për veprën penale “Ndërtim i paligjshëm”, parashikuar nga neni 199/a i Kodit Penal, ma kallezues në ngarkim të shtetasve M.T., A.T., F. Z., A.H., D. D., G.M., T.V. dhe M.D.

Deri në këtë fazë të hetimeve, rezulton e provuar se shtetasit e mësipërm, kanë aplikuar në sistemin E-Leje, nëpërmjet shtetasve A.P. dhe K.B. (Arkitektë), si dhe janë pajisur me lejet e rindërtimit respektive.

Nga një verifikim i thjeshtë i koordinatave nëpërmjet aplikacionit ‘Google Maps’, rezulton se koordinatat e pasqyruara në relacione nga Arkitekti A.P. apo K.B., tregojnë vendndodhje të ndryshme karahasuar me vendndodhjen reale të objekteve të konstatuara nga vetëdeklarimet pranë ASHK-së, apo edhe pa vendndodhje duke mos reklamuar koordinata.

Nga tëdhënat e grubulluara rezulton se objektet janë ndërtuar në ngastrat e ekonomive pyjore 1/a dhe 2/a, në juridiskionin e Bashkisë Tiranë.

Shtetasi G.M. administrator dhe ortak i vetëm isubjektit Certi Ë South Balkans, ka lidhur kontratë qiraje në datën 14.04.2021 me Agjencinë e Parqeve dhe rekreacionit për sipërfaqen 2000 m2, e cila është pjesë e fondit pyjor, ngastra 1/a, për të cilin janë përpiluar aktet pëkatëse, duke u konstatuar se disa prej strukturave me hekur dhe beton si dhe muri rrethues janë të pozicionuara në një sipërfaqe të fondit pyjor e cila ëshë dhënë në përdorim.

Arkitektet A. P. dhe K.B. kanë bërë të mundur aplikimin e të dhënave të cilat tregojnë të dhëna të rreme, nëpërmjet E-leje.

Pas verifikimeve, kërkohet vendosja e sekuestros preventive mbi objektet e ndërtuara nga;

M.T. me sipërfaqe 370 m2, të konstatuar sipas procesverbalit për konstatimin e kundravajtjes nr. 5271 datë 12.01.2023, të IMT dhe vetëdeklaruar me aplikim nr 62 datë 09.02.2023, pranë ASHK;

F.Z. me sipërfaqe 370 m2, të konstatuar sipas procesverbalit për konstatimin e kundravajtjes nr. 5272 datë 12.01.2023, të IMT dhe vetëdeklaruar me aplikim nr 63 datë 09.02.2023;

A.T. me sipërfaqe 370 m2, të konstatuar sipas procesverbalit për konstatimin e kundëvajtjes nr 5270 datë 12.01.2023, të IMT dhe vetëdeklaruar me aplikim nr 65 datë 11.02.2023, pranë ASHK;

A.H. me sipërfaqe 370 m2, të konstatuar sipas procesverbalit për konstatimin e kundravajtjes nr 5269 datë 12.01.2023, të IMT dhe vetëdeklaruar me aplikim nr 72 datë 15.02.2023, pranë ASHK;
