In Tirana, the SPAK Special Prosecutor's Office's investigations into the 10-year sterilization concession may involve a larger number of officials for abuse of office.

The Special Court for Corruption and Organized Crime directed the Special Prosecutor's Office to extend the investigations to the responsibilities of 6 other persons; for former Minister of Health Ilir Beqaj, former Minister of Finance Shkëlqim Cani, as well as for four procurement commissioners.

In the 348-page decision on the prison arrests for the former Deputy Minister of Health, Klodian Rrjepaj, and the businessman Ilir Rrapaj, the Court emphasizes that the SPAK evidence evidences legal violations by the two former ministers and the 4 commissioners.

The arrest of the former Deputy Minister of Health, Klodian Rrjepaj, and the businessman of hospital sterilizations, Ilir Rrapaj, on charges of fraud, forgery and abuse of office in cooperation.

But this seems to be only the beginning of the visible part of the corruption affair of the 100 million dollar concession signed in December 2015 by the former Minister of Health Ilir Beqaj.

Two of the protagonists of the process, Rrapaj and Rrjepaj, are already in prison, two others - the economic and legal directors are under house arrest, four commissioners of the concession are under mandatory appearance, while GJKKO has directed SPAK to expand the investigations to the former minister Ilir Beqaj and former finance minister Shkëlqim Cani.

The Special Court for Corruption and Organized Crime emphasizes in the decision that "regardless of the position of the prosecution, from the analysis of the evidence administered and seen in their unity, they show violations of legal and bylaw acts, which rise to the level of responsibilities criminal charges against former Minister of Health Beqaj and former Minister of Finance Cani, as well as four commissioners of public procurement".

GJKKO notes that from the multitude of investigative data it appears that the winner of this concession was predetermined by the leaders of the Ministry of Health before starting the formal procedures, even the winners prepared documents and adapted the legal criteria in order to ensure the victory.

The investigations have noted the violation of the equality of competitors in the competition, artificial inflation and the multiplication of costs and prices, falsification of documents and statistical figures, the transfer of the new sterilization center of QSUT to the use of the concessionaire, incorrect economic calculations and legal violations , which has fueled suspicions of passive corruption of high state officials.

In the decision of the GJKKO on the arrest measures for them and 6 health officials, it is stated that the former minister Beqaj and his deputy Rrjepaj had continuous acquaintance and meetings with the businessman Rrapaj since December 2013, i.e. two years before this won the concession of hospital sterilizations.

The Special Court for Corruption and Organized Crime noticed during the investigations that, in the emails between them, the former deputy minister Rrapaj receives instructions from the businessman Rrapaj about the actions he must carry out in the Umbria region, part of the feasibility study with the logos and addresses of the company Investital , in communications where it is shown that they both have acquaintances and close friendly relations with each other.

They have studied medicine in the same years, stopped them in the same year and restarted them in the same year.

Businessman Rrapaj, former Minister of Health Beqaj and his deputy Klodian Rrjepaj traveled together by plane from Italy in June 2014, a period that according to investigations coincides with the preparatory actions of the concession.

Likewise, businessman Rrapaj and former deputy minister Rrapaj traveled together by plane to Italy in March 2015, a period that coincides with the announcement of the tender notice within the deadline for submission of offers, the investigators note.

The winning operating companies were informed about the details of the concession they had 6 months before the 10-year contract was announced, even they knew earlier that this procedure would be a concession and not an ordinary procurement.

Rrapaj made a formal registration of his company in Pristina as a tax subject, where he declared himself as the only employee of the company with a salary of 200 euros, while it does not have as an activity the disinfection of surgical rooms.

SPAK notes that the winning operators were fully aware of the concession procedures and pre-prepared the documentation before the contract was announced on February 13, 2015.

Ilir Rrapaj was in constant contact with the Ministry of Health, and according to the investigation, he registered his company Investital LLC in Pristina a month after he flew to Italy with the two heads of the Ministry of Health, Beqaj and Rrjepaj, and a month before the order was issued of the minister for setting up the commission on granting the concession.

Rrapaj also traveled with the vehicles of leading officials of the Ministry of Health, among others, to Kosovo.

After former minister Beqaj and businessman Rrapaj signed the 10-year concession contract for nearly 100 million dollars in December 2015, a series of other air flights to Italy were made by them, as well as former deputy minister Klodian Rrjepaj together with administrators of the winning company in 2016 and 2017.

While the concession is being implemented in its eighth year, and 8 people are under investigation, the GJKKO directed the SPAK to expand the investigations on the criminal responsibilities of the two former ministers Beqaj and Cani as well as 4 commissioners of procurements./ VOA
