Veliaj sues the Presidency and SPAK prosecutor, Ols Dado, in the Administrative Court: He was appointed to the position without completing the Magistrate's School

The Mayor of Tirana, Erion Veliaj, is seeking the declaration of absolute invalidity of the decree appointing a notary to the position of prosecutor, when it was not permitted by the law of the time without first completing the Magistrate's School.

Veliaj has filed today at the Administrative Court of First Instance in Tirana, a lawsuit against the institution of the President of the Republic of Albania from 2007-2012 and the Special Prosecutor, Ols Dado, requesting the determination of the absolute invalidity of the decree appointing the latter as prosecutor by a notary in 2008.

According to the lawsuit, the appointment of the prosecutor was carried out in flagrant violation of the law, as at the time of the decree he did not meet the mandatory legal criteria for exercising the function of prosecutor - without the relevant Magistrate's School.

Veliaj also requests that the High Prosecutorial Council be forced to make a decision on the immediate termination of the magistrate's status and the illegal exercise of the prosecutor's duties in question.

The lawsuit emphasizes that all criminal actions taken against Erion Veliaj, including security measures and the limitation of the exercise of the mandate of the Mayor of Tirana, are based on a 'nul ab initio' appointment act, bringing serious consequences to the Municipality of Tirana, the Republic of Albania, the constitutional order, institutions, family and the person.
