"The police did not take measures when the young man felt bad"/ The

Details from the Ombudsman's report on the case of Lear Kurti's death, where it is stated that the police did not intervene in time to avoid the serious incident. The event took place on October 19, where the young man died in the hands of the State Police, in the premises of police station no. 3.

The report states that the police officers were unclear and did not take measures when this person felt bad. Referring to the report, the policemen were unclear but contradictory as to why this citizen was accompanied.

According to the Prosecutor's Office of Tirana, the cause of Kurti's death is the Anatomical-Pathological diagnosis, caused by an acute overdose (poisoning) with cocaine-type narcotics. We remind you that Lear Kurti's family members have accused the police, claiming that the young man had signs of violence on his body.

REPORT

Taking into consideration the nature of the case, in such cases the police services could prevent this event, under the conditions of the actions or omissions that the representatives of public order were obliged to perform. Based on these statements and referring to Article 109 of the above-mentioned law, it appears that the police officers have acted contrary to the above provision, because it is not possible to escort a person based only on unreasonable suspicions.

According to the cited provision, the suspicions must be reasonable, for the commission of a crime, to prevent the commission of a criminal offense, or for the identification of the person against whom investigations are conducted. Also, the inspection of the association register was carried out, where the cases should be reflected of companionship.

During the examination of the aforementioned documentation, it was found that the citizen Lear Kurti was not recorded in this register after his escort to the premises of the police station. Based on the rules of escorting persons to the premises of the police station, the minutes of the documentation of the actions carried out with the escorted person must be kept after the actions of the verification and clarification of the case for the person, by the police officer, as well as the documentation of the data, generalities of the citizen for the time of his entry and stay at the Police Station, the quality and legal causes of the restriction of freedom.

Me shkresën nr.3858/3 Prot, datë 26.10.2022, kthim përgjigje nga Drejtoria e Përgjigje e Policisë së Shtetit përkatësisht, Departamenti për Sigurinë Publike ka dërguar pranë Institucionit të Avokatit të popullit DVD me pamjet filmike të kamerës së sigurisë të Komisariatit të Policisë nr.3 Tiranë , në DVP Tiranë, për datën 19.10.2022, theksojmë se nga këqyrja e këtyre pamjeve ato nuk janë të plota në të gjitha ambientet e Komisariatit.

Nga këqyrja e këtyre pamjeve nga Nd/komisionerët e avokatit të Popullit, pamje filmike të korridorit hyrës të derës kryesore në komisariat vërehet se: Patrulla ka sjellë në komisariat shtetasin Lear Kurti i cili në duar mban pranga, i shtrirë në tokë në gjendje të keqe shëndetësore me dridhje trupi.

Në këto pamje duken punonjësit e policisë të cilët përpiqen ti japin ndihmë, shtetasi L.K ka qëndruar në ambientet e komisariati për 4 minuta dhe më tej është marrë nga patrulla e cila edhe e kishte shoqëruar më herët.

Marrjen e masave të nevojshme nga Drejtoria e Përgjithshme e Policisë së Shtetit për të ushtruar kontroll në mënyrë të vijueshme në të gjitha strukturat vendore të policisë lidhur me zbatimin e kritereve të shoqërimit të shtetasve dhe respektimin e të drejtave ligjore të personave të shoqëruar si dhe ushtrimit nga titullarët të kërkesave rigoroze llogarie për zbatim të procedurave në rastet e shoqërimit të personave.
