The National Chamber of Advocates has reacted harshly to a clash that occurred two days ago in the courtroom between SPAK prosecutor Behar Dibra and lawyer Gentjan Rumano, who defends one of the people accused in the "Golden Bullet" case.

" Can you stop it, we won't listen to this idiot's nonsense ," said prosecutor Dibra, addressing lawyer Gentian Rumano, who insisted on the request to exclude the jury.

The lawyer immediately left the courtroom, and the jury asked the parties to exercise restraint.

The Albanian Bar Association expresses its deep concern regarding the incident that occurred near the Special Court on July 10, 2025, and says that it strongly condemns the inappropriate, insulting and denigrating language used by the representative of the prosecution.

"Insults and personal denigration of a lawyer in the exercise of his duties constitute not only a serious violation of his professional dignity, but also a flagrant violation of the principles of due process and equality of parties in a trial," the statement says.

Further, the Chamber led by Maks Haxhia emphasizes that these repeated cases, moreover made in the presence and before the trial panel, whose reaction leaves much to be desired, indicate a consistent offensive and contemptuous behavior towards the defense representatives.

According to her, this unethical communication model violates the regular functioning of justice, undermines the equality of the parties and damages the institutional image of the prosecution but also of the entire "New Justice" system, which cannot and should not be tolerated.

The Albanian Bar Association condemns the offensive language used against the lawyer in the courtroom during the trial called "Golden Bullet" – LAWYERS ARE NOT INTIMIDATED

The Albanian Bar Association expresses its deep concern regarding the incident that occurred at the Special Court for Corruption and Organized Crime, on July 10, 2025, during the court session of criminal proceedings no. 75/2022.

Ajo dënon me forcë gjuhën e papërshtatshme, fyese dhe denigruese të përdorur nga përfaqësuesi i organit të akuzës Prokuroria e Posaçme (SPAK), z. Behar DIBRA, ndaj avokatit Gentjan RUMANO, anëtar i Dhomës së Avokatisë Tiranë. Fyerjet dhe denigrimi personal i një avokati në ushtrim të detyrës përbëjnë jo vetëm cënim të rëndë të dinjitetit profesional të tij, por edhe një shkelje flagrante të parimeve të procesit të rregullt ligjor dhe barazisë së palëve në një gjykim.

Mbi të gjitha përbën shkelje të drejtëpërdrejtë të Kodit të Etikës Profesionale të Prokurorëve që kanë të bëjnë me sjelljen profesionale dhe etike (neni 4), respektimi i të drejtave të palëve dhe pjesëmarrësve në proces (neni 7) si dhe marrëdhëniet korrekte me përfaqësuesit e mbrojtjes (neni 15). Duhet të bëhet e qartë për këdo se: Avokati, si garantues i të drejtave të qytetarëve dhe mbrojtës i ligjit, gëzonë mbrojtje të posaçme në ushtrimin e funksionit të tij, si një subjektë i barabartë dhe garantues në proçesin e dhënies së drejtësisë dhe për këtë duhet të trajtohet me respekt dhe barazi nga çdo Gjykatë në sistem. Fatkeqësisht, Dhoma konstakton se ky nuk është një qëndrim i izoluar, nga përfaqësuesit e akuzës, qoftë në proçesin në fjalë ashtu edhe në proçese të tjera.

Këto raste, të përsëritura, për më tepër të bëra në prani dhe përpara trupit gjykues, reagimi i të cilëve lë shumë për të dëshiruar, tregojnë për një sjellje të qëndrueshme fyese dhe përçmuese ndaj përfaqësuesve të mbrojtjes dhe një model të qëndrueshëm komunikimi jo-etik, që cënon funksionimin e rregullt të drejtësisë, minon barazinë e palëve dhe dëmton imazhin institucional të prokurorisë por edhe të gjithë sistemit të “Drejtësisë së Re”, që nuk mund dhe nuk duhet të tolerohet.

Dhoma e Avokatisë e Shqipërisë sjell në vëmëndje se çdo ndërhyrje, apo sjellje, që pengon ushtrimin e lirë dhe të pavarur të profesionit të avokatit bie ndesh me Kushtetutën e Republikës së Shqipërisë, me standardet ndërkombëtare të përcaktuara në konventat Republika e Shqipërisë aderon, me përcaktimet në Kodin e Proccedurës Penale si dhe ligjin “Për profesionin e avokatit në Republikën e Shqipërisë”.

Çdo formë denigrimi apo fyerjeje përbën jo vetëm një cënim të dinjitetit individual të avokatit, por edhe një dëm të drejtpërdrejtë ndaj sigurisë juridike dhe standardeve demokratike të një procesi të rregullt ligjor.

The Albanian Bar Association firmly condemns any behavior that contradicts the principles of equality of arms, mutual respect and the right to effective defense, and therefore it will follow with full attention the relevant developments regarding this event and requests the competent bodies (High Prosecutorial Council and High Inspector of Justice) to analyze the specific case responsibly. The Albanian Bar Association expresses full solidarity with the offended colleagues and guarantees all its members that it will always stand in defense of the integrity, independence and dignity of the legal profession. It will responsibly and continuously monitor the progress of the process not only in this specific case but also in other cases related to such insulting and denigrating attitudes of colleagues, escalating its position as well.
