The head of the ILD presents the annual report in the Parliament: In 2024 we received 1491 complaints against judges and prosecutors!

The Head of the High Inspectorate of Justice, Artur Metani, at the Committee on Legal Affairs and Public Administration, began his speech by remembering Judge Astrit Kalanë, who was murdered a week ago at the Court of Appeals.

While presenting the report, he said that it does not only include figures, but a panorama of the problems of the judicial system from the perspective of the ILD.

He further said that in 2024, the ILD received 1491 complaints against judges and prosecutors.


"Secondly, allow me to appreciate the important role of the Assembly in this situation that we have been through and are going through since the incident at the beginning of last week. What happened was shocking for everyone. I thank the Assembly for the solemn act of honoring the judge with a minute of silence. Human and institutional solidarity is vital in facing such situations, where finding the right boundaries to separate, on the one hand, the problems of the system, the well-founded and unfounded dissatisfaction with the work of judges and prosecutors, and on the other hand, extreme reactions with a very heavy price, is very difficult.

With these feelings, we have prepared this report with our colleagues, presenting here not only figures, but also an overview of the problems of the judicial system today, according to the perspective of the High Inspector of Justice, as well as the challenges that we, the bodies of the justice system, but also other institutional and public actors, must address.

Thus, during 2024, 1491 new complaints against judges and prosecutors were filed with the ILD. 1363 complaints were carried over from previous years. In total, for 2024, the High Inspector of Justice had 2854 complaints to handle. Of these, 1374 complaints were reviewed, of which 54 ended with a disciplinary investigation. In addition to citizens, during 2024, there were also complainants from institutions of the system, such as the president of the court with 2 complaints, heads of prosecutors with 20 complaints, the Independent Qualification Commission with 2 referrals for competence and the High Court with 4 decisions to ascertain the violation of the reasonable deadline.

Përveç ankesave më sipër, gjatë vitit 2024, ILD ka shqyrtuar edhe një numër të konsiderueshem kërkesash nga KLP e KLGJ, për vlerësimin e magjistratëve për periudha të ndryshme vlerësimi. Për 118 kërkesa të sjella nga Këshillat, Inspektori i Lartë i Drejtësisë ka shqyrtuar 674 ankesa dhe janë në faza të ndryshme trajtimi 11 ankesa. Konkretisht, 578 ankesa janë shqyrtuar, bazuar në 64 kërkesat që ka sjellë KLGJ dhe 9 ankesa janë në faza të ndryshme trajtimi. Ndërsa 96 ankesa janë shqyrtuar për KLP, bazuar në 54 kërkesat që i janë drejtuar ILD-së dhe 2 ankesa janë në fazë shqyrtimi fillestar. Edhe gjatë vitit korrent, dy Këshillat kanë përcjellë kërkesa për ILD në kuadër nevojës për vlerësimin e magjistratëve. 71 kërkesa kanë ardhura nga Këshillat deri në fund të shtatorit, për të cilat ILD ka shqyrtuar 842 ankesa dhe 5 ankesa janë në fazë verifikimi. Pra vetëm për vitin 2024 deri në shtator 2025 janë 1534 ankesa për trajtim nga ILD me kërkesë të Këshillave. Inspektori i Lartë i Drejtëisë ka trajtuar 1516 ankesa, vetëm 18 ankesa janë në proces. Pra është një punë voluminoze dhe trajtimi i tyre bëhet me prioritet për të mos penguar KLGJ-në e KLP-në në proceset e vlerësimit të gjyqtarëve e prokurorëve, edhe në funksion të ngritjeve në detyrë e transferimeve, sipas nevojave të Gjykatave e Prokurorive për të plotësuar vakancat e tyre.

Krahas trajtimit të këtyre dy kategorive të ankesave, gjatë vitit 2024 janë përfunduar 6 inspektime tematike, ndërsa në nisje të vitit kalendarik si zakonisht, Mbledhja e Përgjithshme e Inspektorëve ka miratuar kalendarin me 6 inspektime tematike.

Gjatë vitit 2024, ka një dyfishim të kërkesave për procedim disiplinor, krahasuar me një vit më parë. Konkretisht për këtë vit janë 11 magjistratë të proceduar, 6 gjyqtarë dhe 5 prokurorë për shkelje disiplinore gjatë ushtrimit të funksionit, si:

Vonesa të përsëritura ose që sjellin pasoja të rënda apo zvarritje të pajustifikuara të veprimeve dhe/ose akteve procedurale.

Mosrespektim i rëndë ose i përsëritur i legjislacionit procedural dhe material ose zbatimi i gabuar i legjislacionit procedural dhe material, kur konstatohet nga një gjykatë më e lartë.

Mosparaqitja e kërkesës për heqje dorë nga procedimi ose gjykimi i çështjes, kur kjo është e detyrueshme, sipas ligjit; shkelje e rregullave të papajtueshmërisë ose të parandalimit të konfliktit të interesit, sipas parashikimeve të legjislacionit në fuqi.

Përdorimi i statusit të magjistratit, me qëllim krijimin e përfitimeve për vete ose për të tjerët.

Veprimi, mosveprimi ose sjellja e magjistratit, që sjell përfitime të padrejta ose dëme për palët në një proces gjyqësor ose procedurë hetimore, në kundërshtim me ligjin.

 Shkelja e përsëritur ose e rëndë e rregullave të solemnitetit, rregullave të sjelljes në marrëdhëniet me palët, subjektet e tjera të përfshira në proces, me kryetarin, magjistratët e tjerë, si dhe me personelin e administratës gjyqësore.

Thus, the disciplinary measure "dismissal from office" was proposed for 6 judges (2 requests were accepted, 1 request was rejected; 1 request was suspended; 2 requests are in process in the reporting year)

5 prosecutors have been sent for disciplinary proceedings to the KLP. In 2 cases, a “Confidential Notice” was proposed; in 3 cases, “Temporary salary reduction of up to 40% for a period of one year”. (1 request has been accepted and 2 have been rejected, 2 are in process during 2024.)

From its activities, the High Inspector of Justice has identified several issues and conclusions.

Length of trials beyond reasonable deadlines, protracted investigative actions and delays in reasoning judicial decisions

The effectiveness and standard of the justice system is not at the appropriate and satisfactory level for Albanian citizens. As far as can be seen, the excessive length of judicial proceedings continues to be problematic, a problem consistently highlighted by complaints, the jurisprudence of the ECHR, but also in the reports of international organizations. In its latest decision-making, the ECHR has also addressed concrete recommendations to the domestic authorities, emphasizing the need to fill the vacancies in the Administrative Court of Appeal and the Court of Appeal of General Jurisdiction. The excessive length of judicial proceedings directly affects the perception and trust of the public in the justice system, the increase of whose trust is one of the main reasons for which the justice reform was conceived and undertaken.

"Through the available legal instruments, the High Inspector of Justice has addressed this issue, through recommendations of a regulatory and administrative nature, which resulted from the thematic inspection carried out at the Court of First Instance of General Jurisdiction in Tirana, on the duration of the trial of judicial cases, during the period 01.03.2023-31.05.2023, an inspection already concluded with concrete recommendations for the actors of the justice system," he said.
