"I have been waiting for a divorce for 2 years. I came from Greece a few years ago after separating from my husband, but we were not legally separated. We got married here and I wanted to formalize the separation. The problem is that I am cohabiting with my partner here in Tirana and I want to formalize the relationship. It's hindering me because I can't get any documents because I'm still married to my ex-husband. In addition, in order for my son to visit me, I have to get a power of attorney from my ex-husband since the son is not yet 18 years old."
Migena, 40-year-old beautician in one of the big centers in Tirana, says she is tired of this procrastination. She says that she has changed two lawyers for this case, but apparently the fault is not with them but with the lack of judges for family cases.
Asked by Gazetasi.al, the lawyers say that in the Court of Tirana you have to wait up to a year for the drawing of lots for the date of the first court session for family matters, marriage dissolution, domestic violence, child pensions, etc.
"There are court cases that last for 3 years. I have seen at the doors of the courts, especially women seeking divorce, who come several times a year from abroad, but the process cannot start, because there are no judges", say the lawyers.
Lawyer Adriatik Lapaj says that what is happening in the Court of Tirana is a masquerade.
Of the 16 judges who were in 2016, as a result of the Vetting, only 4 remain, where two of them are confirmed and continue their work, while 2 others are in the process.
"With 4 judges, where the fate of 2 of them is unknown, the section of family cases risks melting. Don't forget that nearly 50 percent of family case files are filed in the Tirana court. Many women who are de facto separated from their husbands have children with their new husbands, but the court registers the children with their first ex-husbands since there is no divorce. And so they are forced to process it. There are others who even risk their lives as a result of violence from their spouses and want to get a divorce, but the pile of files in the court is becoming a mountain. At least they have to wait 8 months to draw lots in court for the date of the hearing", say the lawyers.
This anticipation, created in the last 2 years, is harming especially the children of separated parents, who are left without alimony since only legally the fathers are forced to pay. The social drama but also the economic cost seems to be mostly affecting women in economic difficulties. But there is no answer from the Tirana court. Until then, Migena and women who share the same problem will wait for the day of divorce, while her child turns 18 to move freely without the permission of one parent./GazetaSi
