The Constitutional Court has left in force the law "On the treatment of property and the completion of the process of property compensation".

The Constitutional Court says that after examining the request by the Albanian Muslim Community for the repeal of some articles, it was decided by a majority of votes to overturn it.

"The Constitutional Court, after considering the request and claims presented by the applicant, as well as the objections of the interested entities, the Assembly of Albania, the Council of Ministers and the Property Handling Agency, at the end of the examination of the case today, on 13.02.2024 , by majority vote and unanimously for one claim, decided to dismiss the claim. Regarding the research regarding the repeal of point 2 of VKM no. 313/2023, in the part that added points 3/1, 3/2, letter "c", the applicant claimed the violation of the principle of legal certainty, the right to private property, the right to fair remuneration, the principle of proportionality and the principle of equality before the non-discrimination law. The court found that point 2 of the VKM no. 313/2023 has reflected with the same content the changes in the compensation calculation formula provided for in the law. As long as the latter was not found to be incompatible with the Constitution, the Court assessed that even this provision of the VKM does not conflict with the Constitution", the GJK emphasizes.

The Albanian Muslim community sued for the repeal of some articles of this law, which was amended in October 2023.

This community was against the method of calculating financial compensation for properties.
