The Supreme Court clarified the decision: Why did we reject Tahir's release
Saimir Tahiri

The Supreme Court clarified the reasoning behind the decision through which it overturned the request of the former Minister of the Interior, Saimir Tahiri, for the suspension of the prison sentence. The former minister addressed this court in April of this year, almost 2 months after he was in prison following the sentence of 3 years and 4 months given by the Special Appeal for the charge of "abuse of duty".

Tahiri asked the court to release him from the cell with the claim that because of the function he had held, his life in prison was in danger and that his family members were exposed to exponents of the world of crime. In the decision of the Supreme Court, provided by A2 CNN, the Criminal Panel composed of judges Ilir Panda, Medi Bici and Sandër Simoni reasoned that the former minister had not presented any documentation to prove his claims.

"In the case under consideration, there is no indication that the petitioner could become an object of the crime figures who are serving their sentence in IEVP Fier, and there is also no indication that the immediate serving of the prison sentence of the convict Saimir Tahiri, may have serious consequences for the convict himself, as well as for his family", it is stated in the reasoning of the decision of the Supreme Court.

The Penal College further assessed that it is not enough just to highlight the problems, or the hypothetical possibilities for the consequences that Tahiri or his family members may have, but it is necessary that the risk be real and grounded.

"For the period that he is in prison, it does not result that there is any complaint from the petitioner Saimir Tahiri, referring to certain persons, who are characters of the crime and who are currently serving their sentence in IEVP Fier, as the petitioner claims in the request, who with their actions, have become the reason for endangering the physical integrity of the applicant", it is stated, among other things, in the reasoning of the decision of the Supreme Court

On the other hand, the Penal College reasoned that the danger posed to Tahir or his relatives must not only be real, but such that it could be avoided only through the suspension of the execution of their relative's sentence. The former Minister of the Interior, Saimir Tahiri went to the cell on February 4. Initially, he was placed in Fier prison, while in July he was transferred to Lushnja prison, at the request of his family members.

Currently in the Supreme Court, the appeal filed by the former minister who claims innocence and by SPAK, which demands 12 years in prison for Tahir and the former chief of the Vlora Police, Jaeld Çela, for the charge of "narcotics trafficking" and " to the structured criminal group"./ A2
